Research On The Liability Insurance System For Real Estate Registration Error Compensation

Since the landing of the unified registration system of real estate,the number of cases of reconsideration has increased significantly because of the letters and visits of compensation for errors in the registration of real estate,It can be seen that the risk of compensation for registration errors of real estate is also increasing.At present,the provisions on compensation for false registration of real estate in our legislation are too principled,resulting in damage caused by errors in registration of real estate is difficult to define;Secondly,the damage caused by the wrong registration of real estate is easily millions,and the national compensation model obviously increases the burden of the national finance.Thirdly,because of the small amount of the registration fee in our country,It is obviously not enough to take this risk by drawing a certain proportion of the liability fund from which to set up a liability fund.Based on this,the Nantong Real Estate Registration Center and the insurance company have explored the establishment of real estate registration liability insurance.Based on the experience of this case,this paper analyzes the necessity and feasibility of introducing immovable property registration error liability insurance system.Based on the theory of liability for false registration of real estate and the theory of liability insurance in insurance law,This paper constructs the insurance system with Chinese characteristics from the two aspects of the insurance system and the compensation related system of the insurance for the false compensation liability for the registration of immovable property.
