A Comparative Study Of EU And US On The Electronic Identity Management Legislation

It is often a fundamental issue to verify the identity of remote parties in the course of electronic transactions.In recent years,with the rapid development of global e-commerce,many countries all over the world begin to pay attention to the importance of creating an identity trust environment and regard electronic identity management as one of the main technical paths.However,in the field of electronic identity management,the relevant legal rules need to be clearly clarified.At present,the UNCITRAL has started its research progress on the international legislation on identity management and trust services,and the EU and the United States have also made prominent legislative progress in this respect.In this context,this paper first summarized the current research status and then indicates the purpose of this research.Second,it describes the electronic identity management is mainly a combination of identification and authentication process,pointing out that it has links with the electronic signatures concerned by traditional legislation.At the third and the fourth part,by laying out the legislative history?purpose and focal point of EU and US electronic identity management,it will pave the way for subsequent legal comparisons.Fifth,the article focuses on the EU eIDAS Regulations and the United States "Virginia Electronic Identity Management Act" to conduct a comparative study which combines other legal documents and related policies and guidelines,including the content of electronic identity management itself and the trust services which related to electronic identity management closely.Finally,based on the above study results,the sixth part analyzes the status quo of our country's current legislation,puts forward some suggestions that our country should legislate to speed up the construction of a identity trust framework for the implementation of our national strategy,and raise the position and response that our country could take when participate in the UNCITRAL's working progress.
