Research On The Reform Of Judges’ Post System

The reform of judge post system is the basis of the reform of judicial responsibility system,because it involves the change of personnel in the court,which is regarded as "self reform" within the court,and it is the "cheese" of the judicial personnel themselves.It is known as the "most difficult piece of bone" in the reform of the judicial system.Now,the nationwide reform of the quota system for law officials has basically been completed.However,there are still many defects to be corrected in the reform,many problems need to be solved,and many contradictions need to be resolved.Through the study of many problems in the reform of the legal quota system,this paper takes the reform practice of Binzhou,Shandong Province as a sample,and analyzes the necessity of the reform in an all-round way,including the contradiction of "few cases" in the "few cases" before the implementation of the reform,the serious mental imbalance of the judges,the administration of the case,the lack of competition mechanism and so on;and the feasibility of the reform is carried out.The research,including the advanced experience of the pilot provinces and cities in Shanghai,Guizhou and Jilin,and the long-term practice of the judge system in Britain,the United States,Germany and Japan,and the profound analysis of the inequity in the process of the reform,such as the inequity of the assessment process of the quota,the interference of the judges’ handling cases,the unsound assessment mechanism of the judges and the unobstructed promotion channels,etc.The problem.Through the analysis of the deep-rooted causes of the problems,and combining with the advanced experience and practice of foreign countries,suggestions are put forward to improve the reform,further promote the process of professionalization of judges,further improve the reform of various working mechanisms,and further promote the continuous deepening of the reform of the judicial system.
