The Revolution Of Commercial Registration System In The Context Of Economy Ruled By Law

The economy ruled by law refers to the regulation of economic relations,the regulation of economic behavior,the guidance of economic operation and the maintenance of economic order through the form of law,and the economic develops rapidly,orderly and sustained in accordance with the expected way.Its core problem is to accurately position the relationship between the government and the market.“Market economy is the rule of law economy” has become a consensus.And this thought,also is the rule of law compass of economic construction.In recent years,in order to promote the development of the market economy,the Chinese government has implemented the reform of the commercial registration system,lowered the threshold for market access,simplified administration and decentralization,and readjusted the relationship between the government and the market.It has greatly reduced the threshold of the establishment of the company,realized the return of the right to the market,returned the right to the main body of the market,stimulated the vitality of the main body of the market,promoted the decentralization of government power,and made great contributions to the sustained and healthy development of the economy.At present,the reform of commercial registration system,as the vanguard of the reform,has entered deep water area.With the deepening of the reform,the scope of the reform continues to expand and the difficulty increases,and the reform of the commercial system also exposes some problems.For example,the reform of the transfer of registered capital to subscription has increased the risk of market transactions,easy to register enterprises bring problems of subsequent supervision and so on,which breed the hidden danger of safety in the market transaction.In the course of the reform,the problems encountered must be overcome at any time,and the reform of the commercial system should be urgently improved.In October 2017,the party's 19 th CPC National Congress report stated that it is necessary to deepen the reform of the commercial system and break the administrative monopoly.In essence,the reform of commercial registration system is the practice of the economy ruled by law,and must depend on the thinking of law and the way of law in order to promote the reform better.In the context of the economy ruled by law,this paper explores the reform of the commercial registration system in China,referring to the foreign legal system and the pilot work experience of some domestic regions,combining the author's work practice and personal experience.This paper analyzes the problems during the reform of the commercial registration system,and puts forward some suggestions for deepening the reform of the commercial registration system.This paper is divided into five parts.The first part discusses the definition and connotation of rule of law economy;the second part expounds the origin and development of commercial registration system in western countries and China;based on the theory of commercial registration system and power,the paper analyzes the difficulties of the reform.The fourth part puts forward some suggestions on how to deepen the reform and perfect the commercial system.
