The Value Conflicts And The Basic Principles Of Resolving The Law In Network Violence

The improvement of Internet technology and the popularization of Internet,we are entering a new era of the Internet.The Internet has integrated into all aspects of our lives and changed the traditional way of life.It brings us great convenience,and it also has some negative effects.the network violence is a typical example.Network violence is mainly manifested in the network language violence and the rampant human flesh search,internet users use online platforms to insult,slander others or freely disclose others' privacy,and infringe upon the right of reputation and privacy of others,causing serious social impact,it should be effectively controlled.This paper mainly adopts the method of value analysis,analyzing the meaning and characteristics of network violence,and gives a brief overview of the concept of the value of law and the expression of conflict,then it elaborates the manifestation and reason of the value conflict of law in network violence.Finally,it proposes the basic principle of resolving this conflict,and provides some suggestions for the solution of network violence.This paper is divided into five parts to complete the discussion.The first part is the introduction.In the introduction,the research background,research significance,domestic and foreign research status and research contents and methods are briefly explained.The second part expounds the connotation and characteristics of network violence,and the meaning of the value of the French,content and specific forms of conflict do a simple overview,for the following discussion to lay the theoretical foundation;The third part introduces the concrete manifestation of the value conflict of law in network violence,which is mainly the conflict between individual freedom and other people's rights and interests as well as individual freedom and the rule of law.The fourth part mainly analyzes the law of value conflicts in the network violence,the subject of diversity and difference,the complex dynamics of society itself,cultural factors and special time background is the main cause of the conflict to produce the cause of the conflict of value;Fifth part on the basis of the argument focused on resolving method of the basic principles of value conflicts in network violence: value status principle,case balance principle,proportion principle and subject identity and external unified principle,the combination of hope in the governance of network violence have a correct value choice,make contributions to the establishment of the rule of law society.
