The Research On Legal Issues Of Rural Land Endowment

Land is the material basis for the subsistence and development of farmers.With the acceleration of the aging of our country's population,the situation of old-age security in rural areas is becoming more and more serious.This paper chooses the research on the legal problems of rural land pension security as the topic,and makes a study on the existing land pension model of our country,the legal problems and causes of the existing rural land pension model of our country,from the practical and theoretical perspectives,and then puts forward some suggestions on the construction of the relevant legal system of rural land pension security of our country.In particular,this paper focuses on the following issues:Firstly,the meaning of "rural land endowment" and the extension of "land";This paper summarizes the existing four main rural land endowment models(including reverse mortgage,land trust,land use right recovery and redistribution,responsibility land endowment insurance).The background and reason of rural land endowment generation and development are systematically answered.Secondly,the legal problem of rural land endowment model in China has four aspects: the legal risk ability of rural land income is weakened;The farmers have different opinions on the feasibility of the law on land endowment.The legal sticking point in the process of rural land endowment is the institutional obstacle to rural land endowment.There are five aspects in the analysis of the causes of the rural land endowment security law: the lack of government legal responsibility and the management strength;The natural orientation of rural land in law;The contradiction between farmers 'traditional thinking and legal thinking;The institutional burden of rural collective economic organizations;The land circulation market lacks legal support.Finally,it puts forward some suggestions on the construction of the relevant legal system of rural land endowment in China.Rural land management form diversification development strategy;Strengthening farmers' independent joint operation;Land property rights system,etc..It is emphasized that the land transfer has a great influence on the rural land pension security,so it makes some suggestions on the construction of the legal system during the land transfer.
