| In recent years,the application field of Internet has been expanding.Shopping through Internet has become a new consumption mode.However,with the rapid growth of the Internet economy,the commercial value of personal information has become increasingly prominent,even part of the personal information has been industrialized,personal information is not collected and used,causing the security of the personal information of the online consumers to face a huge threat,and also has a negative impact on the development of network consumption.At the present stage,due to the late start of the legislative protection and practice of personal information in China,the legal system of the personal information field is lagging behind,which weakens the protection of the personal information of the online consumers.Therefore,it is urgent to analyze the existing problems of personal information of online consumers in the present stage,seek protection measures from the protection system,relief system and industry self-discipline,and strive to protect the personal information of online consumers in an all-round way.Based on the relevant laws and practices of personal information protection of online consumers,this paper discusses how to protect personal information of online consumers.First,the paper puts forward the topic of the research,namely the personal information of the network consumer,briefly expounds the basic content of the personal information of the network consumer,including the concept and classification of the personal information of the network consumer,clarifies the legal attributes of the personal information,and expounds the necessity of protecting the personal information of the network consumers at the present stage in China.Secondly,we draw the research content from the case,that is,the protection of personal information of online consumers.This paper briefly expounds the form of personal information expression of network consumers,points out the core of protecting the personal information of online consumers,and analyzes the status of the protection of personal information of online consumers,including the existing legislative status and existing problems.Thirdly,it analyzes the relevant personal information protection models in Japan,the United States and other countries,so as to provide empirical reference for our legal protection mechanism.Finally,it puts forward the basic framework and suggestions for how to build a scientific and reasonable online consumer personal information protection system.First,we should perfect the personal information protection system,clear the scope of the personal information protection of the network consumers,set up the personal information differentiation protection system of the network consumers.Secondly,this article holds that the personal information of the network consumers should be protected by the principle of liability for fault liability in the tort liability system,and the distribution of the burden of proof should be based on the disadvantaged position of the consumer.Finally,from the perspective of self-discipline of the industry,some suggestions are put forward to improve the reasonable and efficient legal system of personal information on online consumers in order to strengthen the protection of the industry on the personal information of online consumers. |
