Research On The Protection Of Personal Information Rights Of Online Shoppers

Before we knew it, we entered an era of consumer participation in online shopping. Online shopping has become a daily phenomenon,which is always with us. It is because of the rise of online shopping, the expansion of the scale of online shopping, online shopping consumer personal information in e-commerce increasingly commercial value, their information data becomes hot. And the corresponding personal information right has become the object that people must pay attention to. But at present our country to the protection of personal information right is still insufficient, the infringement of the online shopping consumer’s personal information right has occurred. This requires us to analyze the reasons, explore countermeasures, improve the corresponding laws and regulations, in order to protect the legitimate rights and interests of online shopping consumers, building a good online shopping environment.This paper mainly contains four parts:The first chapter mainly describes the characteristics of online shopping consumers’ personal information, the concept of online shoppers’ personal information rights, and explore the different difficulties between the protection of online shoppers’ information rights and traditional shopping consumers’ information rights.The second chapter lists the main content of the online shoppers’ personal information rights,and compared the opinions of different scholar in different countries; at the same time describe the pattern of manifestation to infringe the online shoppers’ personal information rights including the violation of content, behavior two aspects. Mainly contains the infringement of online consumer information decision, information delete rights,the right to confidentiality of information, information collection informed, choice, information inquiry right and personality rights and property interests, illegal collection, sell, use of personal information of consumers in online shopping.In the third chapter,the author from the "consumer protection law" on the protection of consumers, spreads a discussion. Discribe the principle of the "consumer protection law" to protect the personal information rights of consumers, the new increased or revised provisions to protect the shoppers’personal information rights. Finally, for the characteristics of online shopping consumers, list some problems still in the "consumer protection law",which have lacks of protection for online shoppers.In the fourth chapter, the author tries to put forward measures to improve the protection of personal information rights of consumers online shopping, mainly divided into three aspects, respectively, from the legislative, judicial, supporting measures to explore countermeasures. In the aspect of legislation, from the legislation pattern, clear subject of administrative protection,tort liability subject and consequences of the tort liability, improve the burden of proof; In the administration of justice, from simple procedure and validation discuss economic compensation; supporting measures in order to improve consumer awareness of their own information protection, strengthen self-discipline, establish social supervision mechanism were discussed.In summary, this paper followed by progressive, first on what is the right of personal information of consumers online shopping, then explore the infringement of the right of personal information of consumers online shopping.Finally, seek protective measures from the legal protection, industry self-disciplinetry, to find a comprehensive online shopping consumer protection of the personal information right.
