Research On The Local Legislation Of Online Car-Hailing In Our Country

Online car-hailing represents the development of sharing economy in China.As the combination of internet industry and transportation industry,it not only changes the trip mode,also promotes the reform of the taxi industry.The promulgation of "Interim Procedures of the Administration of Online Car-Hailing" marks the legalization of online car-hailing in China,and establishes a legal supervision system.However,as a part of urban transportation,the development of the online car-hailing service is different in each city,so local legislation is also carried out accordingly.Over the past more than one year,there have been a series of regulations on the management of online car-hailing services in various regions,which has formed a supervision system for local online car-hailing services.Based on the research on local legislation of online car-hailing in our country,the thesis takes Beijing,Shanghai,Guangzhou,Shenzhen and Wuhan as the representative cities,analyzing their management rules of online car hailing and trying to find the perfect measures for next step.The first part summarizes the research results of the existing local legislative research and analyses the viewpoints to provide reference for this thesis.The second part tells the definition of online car-hailing,summarizes the main characteristics and the relationship between online car-hailing and taxi,and analyses the main legal relationships related to online car-hailing.The third part demonstrates the legislative authority from the perspective of legislative law and practical values of local legislation.The fourth part analyses the current situation of the local legislation of online car-hailing in our country,mainly from the two aspects of form and main content.The fifth part is the existing problems in the local legislation of online car-hailing,which mainly exists in the administrative license,the setting of the admittance condition and the quantity regulation.The sixth part is to perfect the proposal with the theory knowledge of legislation and existing problems,trying to put forward some suggestion for the local legislation improvement.
