Research On The Issues And Countermeasures Of The Adjustment Of Marine Anti-smuggling Functions In Shenzhen Customs

The Chinese customs has four basic functions: supervision,anti-smuggling,statistics and taxation.As one of the most important basic functions,anti-smuggling is an extension of customs authority,which is necessary to crack down on smuggling and illegal activities,and provides important guarantee for the development of China's economic and social development.As one of the most important ports in China,Shenzhen Customs has the longest coastline and is at the forefront of reform and opening-up of China,therefore the coastguard function of anti smuggling is particularly important to Shenzhen Customs Anti-Smuggling Bureau.The Shenzhen Customs Coastguard has the biggest personnel system and the most cruiser in China Customs,taking the heaviest Marine anti-smuggling task and being responsible for the coastline of 400 kilometers from the east angle of the Daya Bay and Daxing mountain,to the west of the eastern Pearl River mouth and Dongbao River.The coastline has been made a "steel wall" against smuggling by the Shenzhen Customs Coastguard.However,with the establishment of the China Sea Police Department in2013,the China Customs' anti-smuggling function will be transferred to the newly established department.The reform of the maritime anti-smuggling function is a test of the service capability of the China Customs and the effectiveness of the anti-smuggling operation.Before the adjustment of maritime anti-smuggling function,the law enforcement forces on sea could not be focused,resulting in low law enforcement effectiveness and waste of resources.Therefore,it is a necessary and urgent move to adjust the maritime anti-smuggling function.In view of this,this thesis carried out the relevant research work based on "the Shenzhen maritime Customs anti-smuggling function adjustment problems and the countermeasures research",such as literature review,questionnaire,case study.This research focuses on the marine anti-smuggling achievements of Shenzhen Customs for many years and the business data from the Shenzhen Customs.It is found that the marine anti-smuggling function of ShenzhenCustoms still has many problems during the process of adjustment,such as the fine collected stays the same and the value of cases has been too high.Since anti-smuggling function being adjusted in 2013,the filing value for smuggling case has not been reduced much,and the marine anti-smuggling situation is not optimistic.In the mean time,based on the research and analysis,it has been found that the relevant laws and regulations have not been formulated,and the enforcement is not enough.There has been lack of police resources,aging of personnel and difficult development.There are also some problems in the law enforcement environment.In view of the above problems,this thesis analyzed the causes including the environment,the market,the system and the law.Finally,the thesis studied how to improve the effectiveness of maritime anti-smuggling function in Shenzhen Customs.The research results of this thesis provide a reference for the adjustment of maritime anti-smuggling function in the customs of other areas in China.
