Research On Anti-monopoly Law Regulation Of Abuse Of Dominant Position In Commercial State-owned Enterprises

The problem of the abuse of market dominance of state-owned enterprises in the commercial category in China is long-standing.The reason is that the existing legal anti-monopoly regulation and government supervision are insufficient and the company's own profit-driven driving.The inadequacy of China's current legal system on the regulation of the abuse of market dominance by commercial state-owned enterprises is the legal root of the problem.Perfecting the anti-monopoly regulation of the abuse of market dominant status of commercial state-owned enterprises is not only an anti-monopoly law but also related laws.To conduct a sound and beneficial discussion is also of great practical significance to promote the development of the national economy and the social harmony and stability.This article is divided into four chapters,analyze and propose countermeasures around the issues raised to discuss the idea.First of all,summarize the anti-monopoly regulation system for abuse of market dominance by commercial state-owned enterprises in China,and make a clear definition of commercial state-owned enterprises according to the latest State Council-related documents and the legal provisions of China.Dissertate the necessity of its anti-monopoly regulation system based on their abuse of market dominance and their performance and causes.The second part of the thesis analyzes the problems existing in the anti-monopoly regulation of the abuse of market dominant status in China's commercial state-owned enterprises,and analyzes the reasons for them,laying the theoretical foundation for future regulations and countermeasures.The third part of the thesis This article puts forward the thinking and countermeasures for perfecting the anti-monopoly regulation system for abuse of market dominant status in China's commercial state-owned enterprises,by taking into account the experiences of foreign countries' abuse of market rule.
