| In 2009, Lucheng District of Wenzhou city began to expand the field of people's mediation and built a "big mediation" system.This study is based on relevant research results at home and abroad, combining the theories of people's mediation and the contradictions among the people.The paper analyzes the foreign ADR model, and emphatically introduces the history, current status and effect of the development of big mediation in Lucheng area.At the same time, it analyzes the existing problems of big mediation in Lucheng:(1) The big mediation involves various departments work of convergence is not smooth enough; (2) The work of building big mediation organization specification development is not balanced; (3)The working mechanism of big mediation is not perfect; (4) The big mediation job security is not in place; (5) The comprehensive quality of the big mediation work team is not high; (6)There are some legal risks exist in the performing of people's mediation agreement.According to the problems above, the paper puts forward the countermeasures and suggestions to improve the work mechanism and system of big mediation in Lucheng: (l)Strengthen organization and leadership, strengthen the mediation work of various departments of cohesion; (2) Improve the network of organizations, to promote the various people's mediation committees standardization construction; (3) Improve the working mechanism, Promote mechanism of Conflicts and disputes information study,and inviting outsider mediators mediate the disputes occuring in nonnative personnel;(4) Strengthen the work of security, Improve the performance appraisal mechanism;(5) Strengthen quality training, improve the people's mediators disputes mediation ability;(6) Strengthen legal publicity, encourage the parties to actively apply to the court for judicial confirmation. |
