| Global warming triggers various problems which happen in many countries.Actually,in the Arctic region which may be the last pure land in the world also faces problems like the melting ice and disturbed balance of eco system.All of them happened suddenly and unexpectedly.Too many countries,the Arctic region is no longer untouchable and it will become the next golden land for human beings to explore.As the ice melting leads to the exposure of the fabulous value of resources,perfect shipping routes and the advantages for research,more and more countries attach great importance on its great valueArctic is surrounded by Russia,the USA and Canada and others,all those countries are very proactive and initiative in dealing with issues concerning the Arctic region.But now all things are changed as it attracts attentions from countries like China which strives for discourse power on the Arctic region by taking part in issue discussing,investing more money to this region and carrying out researches,so that it can safeguard its Arctic rights in this special and valuable area.As Arctic is rounded by many countries which causes complex political situations and multiple interest holders.So nowadays many countries choose to work together in developing the Arctic.But only when all the actions are well disciplined can the region be used in a good way.So under the International law,many countries begin their activities As the legal basis of International orders,the relative International law,especially the International conventions which is called the hard law is not totally suitable for solving the disputes of the Arctic region for now.Even though they cannot make the polar region in a good situation,the International law really plays an important role in the Arctic problem solving as it lays the foundation for multinational negotiations.Through analysis of the past research,I found that research from Chinese scholars is a little bit later than western countries,especially circumpolar nations.,which is more or less is relative to China’s political and geographic situations.In terms of content,the Arctic research mostly focus on the scientific investigation relevant closely to environment,climate,shipping route,climate and other factors which may have great influence on China.In terms of emphasis,though the Arctic study also involves the problem of the rights and interests of a country,the research concerns the law of the Arctic is not as attractive as the research on the topics like Arctic science,political affairs,economy,military matters.The study on the International law system is inferior to the study of the legal conflicts.As the Arctic region becomes more and more important to the whole world along with the ice melting.The recent scientific study of the Arctic issues cannot fulfill the need to defend our interests and right on this polar region,so it is necessary for us to speed up the expedition the fields relevant to the judicial way of Arctic research.Besides our participation in the International legislation,study of the existing International law is the core of polar study.Unlike the Antarctic region,the Arctic region is mostly made up of the ocean,so the interests and rights of the Arctic region,more likely are about the maritime rights which is based on the International maritime law.This essay will discuss about the articles concerning the Arctic region,especially the Svalbard Treaty and the United Nations Convention on the Law of the Sea,together with the national condition and International political situation.And this essay is aimed to give judicial support to protect the maritime rights and interests of China on the Arctic region.The main body of the essay including four parts: part one is concerned with the geographic and political situation of the Arctic region,what’s more,the analysis of the strategic importance of it,which plays the role of introducing the following part.The second is talking about the International maritime laws which are related to the Arctic and to better analyze the maritime rights and interests,I picked up two important International laws,the Svalbard Treaty and the United Nations Convention on the Law of the Sea.The third part is about the theoretical an practical barriers China has encountered when dealing with the Arctic issues.With the analysis of the problems in the third part,in the following part which is also the last part,I put forward the measures of how to protect the maritime rights and interests of China in the Arctic region. |
