Research On The Intellectual Property Clause Of TPP

With the development of society,science and technology play more and more important role.Developed countries have made great contributions to the development of science,they have also obtained great economic benefits through the development and application of science and technology.The protection level of intellectual property rights is often related to the level of economic and technological development,due to the differences in the level of development,countries will not and cannot provide the same level of protection of intellectual property rights.In order to safeguard their interests,developed countries have tried to raise higher standards of intellectual property protection in the global output of technology.Intellectual property clauses have increasingly become one of the focal points in trade negotiations and become an indispensable part of inter-State trade negotiations.From the point of view of the development of international protection of intellectual property rights,protection standards have experienced a process of continuous improvement,and a series of international agreements and treaties have emerged,the intellectual property provisions in the TPP agreement generated under this trend.In combination with the negotiation process of the TPP agreement and the development process of international protection of intellectual property rights,this thesis analyzes and evaluates the main contents of the intellectual property clauses in the TPP agreement and the differences and links of this content with other international agreements,and try to explore its possible impact on China and China's coping strategies.To elaborate questions above,this thesis is divided into four chapters.The first chapter is the introduction,mainly about the origin of the study,domestic and foreign research status and the method of the thesis.In the second chapter,we firstly introduce the process of international protection of intellectual property rights,and point out the dilemma in the international protection of intellectual property.And then introduce the process of TPP and the latest problems it encounters.The third chapter is the core of this thesis.We introduce the main contents of property rights of TPP agreements through four parts,including trademark,patent,copyright and neighboring rights,law enforcement measures.And we compare the contents mainly with the TRIPs agreement and the intellectual property laws of China and try to find out the differences and links,and discuss the possible impact of the intellectual property provisions themselves.In chapter four,we explore the possible impact of the intellectual property provisions of the TPP agreement on China and how China should cope with this impact.
