Research On Anti-doping Legal System In Italy

In the increasingly prosperous sports,abuse of doping has become an important issue that must be faced in sports.This kind of behavior will not only damage the physical and mental health of athletes,but also damage the fair order of sports.Therefore,effective regulation of the use of doping behavior is necessary.Due to the global nature of sports,anti-doping also has strong commonality.Research on anti-doping laws and regulations in other countries in the world can provide reference for the improvement of anti-doping laws in China.Italy is the first country in the world to enact a professional sports law and is one of the few representative countries that criminalize the use of doping.Studying Italy's anti-doping legal system and its implementation results are very valuable for China's anti-doping legislation and the improvement of law enforcement.First of all,through the introduction of the Italian anti-doping legal norms,a comprehensive analysis and analysis of the Italian anti-doping legal norms,including two parts,namely the Italian anti-doping national legal norms and the Italian sports industry specification.Among them,the Italian anti-doping special legislation-Anti-Doping Act No.376 formally criminalizes the use of stimulants,encouragement of doping and stimulant trading,which is the biggest feature of Italian anti-doping legislation.It has certain reference value for the choice of anti-doping regulation means in China.Secondly,through the introduction and analysis of the main anti-doping agencies in Italy,the investigation and punishment,and the investigation and punishment system,we can understand the investigation and handling process of the Italian anti-doping action.Thirdly,through the introduction of the two anti-doping arbitration and litigation solutions in Italy,we understand the Italian anti-doping dispute resolution system.Finally,a general review of the legislation and enforcement of the Italian anti-doping legal system analyzes the advantages of the Italian anti-doping legal system and the obstacles in its implementation.Based on the analysis of the experience and deficiencies in the Italian anti-doping legal system,combined with the status quo of China's anti-doping,and put forward three suggestions for improving China's anti-exciting legal system: first,Selective criminal punishment;second,strengthen Cooperation between government agencies and anti-doping agencies;third,strengthen exchange and sharing of anti-doping information with other countries.Overall,this paper aims to provide reference for the establishment and improvement of China's anti-doping legal system by analyzing and introducing the anti-doping legal system in Italy so as to ensure the healthy development of China's sports industry.
