On The Legal Issues Of Promoting The Public Credit Of Charitable Organizations In China

The credibility of charitable organizations is the foundation of the charitable organizations,and it has a vital role in the development of charity.But in recent years,with the rapid development of China's charity,all kinds of negative news,by the series of "charity scandal",the credibility of charitable organizations has been a major impact.In general,the main contradiction,which exists in the development of charity in China,bringing about enormous social demand and declining the credibility of charitable organizations,because of high speed development of charitable organizations.Therefore,how to enhance the credibility of charitable organizations has become the primary problem in our country charity healthy development,and construction and promotion have become the key issues in the current legislative practice of the charity organization's credibility.In September 2016,?Charity Law of the People's Republic of China ? have plays an important role in promoting the development of the charity,which is the study of an important background and value.In this paper,the credibility of charitable organizations as the research object,mainly adopting the research methods of comparison analysis,case analysis and so on,from analyzing the current situation of the development of charity in China and charity legislation,and through the development process of China's history of charity,at the same time,analyzing and summarizing our experiences and lessons from the development of charity the United Kingdom and the United States' development model and development path,especially the analysis of legislative and regulatory,summing up the experience of outstanding foreign charity development,and then analyzing some major problems existing in China to put forward some suggestions and countermeasures.Based on the concept and importance of the charity's credibility,and through the research on the development of philanthropy and charitable organizations at home and abroad,this paper analyzes the problems existing in the development of China's charity organizations from the perspectives of history,current situation,domestic and foreign perspectives.And then,the paper puts forward the main problems of the credibility of charitable organizations in China,through the "JocieGuo event" triggered by the publictrust crisis of charitable organizations,and mainly points out the lack of credibility of charitable organizations.Therefore,this article then analyzes the reasons for the lack of credibility of charitable organizations,mainly from the four aspects to expound:unsound information disclosure mechanism,imperfect social supervision system,imperfect internal construction of organization,and unreasonable government supervision position,and then combined with foreign the effective practices on enhancing the credibility of the charity and the actual conditions of our country,proposes a set of effective countermeasures toimprove the credibility of the development of the charity in our country.This paper studies the effective countermeasures to enhance the credibility of charitable organizations from the perspective of law.With the background of promulgating the "Law of the People's Republic of China on Charity " and comprehensively implementing governing the country by law,this article aims to improve the credibility of charitable organizations in our country through effective measures.In this paper,from the six levels:improving the charity legislation system,establishing and improving the mechanism of information disclosure,formulating reasonable and effective preferential tax policies,strengthening the supervision of the development of charities,strengthening the internal organizational construction of charities and increasing the publicity of charity development,to indicate that they have a crucial role in promoting the credibility of charitable organizations.Therefore,the author hopes to enhance the credibility of charitable organizations through the study of the legal issues of charitable organizations and then promote the harmonious and stable development of charitable causes in our country.
