On The Subject Of The Particularity Of Civil Aviation Public Security’s Administrative Power Enforcement

The civil aviation public security,which is the special publicsecurity organ set up in civil aviation systems by government, is one ofthe most important law enforcement power of people’s police force,specialized in maintaining the civil aviation transport order anddefending the passengers’ life and property. The attribute of aviationsecurity is the basic difference between the civil aviation publicsecurity and the general public security organs. With the rapiddevelopment of China civil aviation transport of China, people and theinternational community pay more and more attention to the civil aviationsafety issues, and aviation security is referred to the national securityand political security strategy height. However, since the civil aviationpublic security system reform has not yet been fully finished, the civilaviation public security cannot completed fulfill the aviation securitymanagement functions, and this also heavily influences the civil aviationpublic security’s administrative power enforcement. Therefore, it isimportant for us to analyze and improve the main existing problems in civilaviation public security’s administrative power enforcement to furtherensure aviation security. This paper analyzed characteristics of the civil aviation publicsecurity’s administrative power enforcement and discussed thesimilarities and differences between civil aviation public security andpublic security organs in administrative power enforcement. The paperalso introduced the development of civil aviation public security and thecurrent status of administrative power enforcement. Meanwhile,this paperfocused on the analyses of the obvious problems of the civil aviationpublic security’s administrative power enforcement, and targetly putforward some suggestions to improve it. This paper includes four chaptersas follows:Chapter Ⅰanalyzed the characteristics of civil aviation publicsecurity’s administrative power enforcement, mainly in the similaritiesand differences of legal bases, obligations and jurisdictional area withgeneral public security organs.Chapter Ⅱ mainly analyzed the civil aviation public security’spresent situation from the special fields, subjects, legal bases,obligations and acts of civil aviation public security’s administrativepower enforcement.Chapter Ⅲ studied the prominent existing problems of civil aviationpublic security’s administrative power enforcement. This part took a lotof examples to analyze the problems of the civil aviation public securitysystem, legal bases, subjects and acts.Chapter Ⅳ introduced the civil aviation police modes of the UnitedStates, Singapore and Taiwan, which are helpful to perfect civil aviationpublic security’s administrative power enforcement of China. Then itset forward several practical proposals from perfecting aviation securityregulations systems, scientifically and reasonably differentiatingadministrative power enforcement duties, improving the surveillancesystem and strengthening the “three basic level” and standardization constructions in order to further enhance civil aviation publicsecurity’s administrative power enforcement.
