Research On The Legislation Of Ride-hailing Operation In China

Online ride-hailing has been basically popularized all over the country and has become one of the indispensable and important ways for people to travel.China tries to formulate special regulations to promote the standardized development of ride-hailing industry.The resulting "interim measures on the management of online taxi booking services"(hereinafter referred to as the "interim measures")and the local"implementation rules" have been issued to fill in the gap of special laws and regulations in China's ride-hailing industry.After the introduction of relevant regulations,the online car hailing industry gradually gets on the right track,but this move cannot be completed once and for all.The implementation of current laws and regulations still reveals some deficiencies,and there is still room for improvement.This paper mainly takes "interim measures" and local "implementation rules" as the research object,and in accordance with the development of the law,the guidelines on private passenger car sharing issued in many places are also included in the research.Using the method of comparative research,the content of various laws and regulations is compared and analyzed by chapter,and the differences and similarities between them are studied.Then the regulations are summarized,and the existing problems are analyzed based on the actual effect of the implementation of specific provisions,and the methods to improve the laws and regulations of online ride-hailing are proposed.The specific content is as follows:the first part discusses the relevant concepts of ride-hailing,including the distinction and clarification of concepts such as cruise taxi,black cab and private minibus sharing.The second part mainly describes the current laws and regulations on ride-hailing and their positive and negative effects.The third part combine our country "administrative licensing law","insurance law"."network safety" and so on from the relationship with the host law laws and regulations,regulatory agencies,insurance regulation,private car ride,entry criteria,eligible for the program,the driver rights protection,the network information security,etc.,attempt is missing for some existing in the current laws and reuulations,unreasonable problems are expounded respectively.The fourth part mainly describes the specific regulations of the United States,Britain,France and Germany on ride-hailing,and tries to analyze the benefits for the perfection of China's laws and regulations on ride-hailing.The fifth part,combined with the above parts,puts forward some immature ideas or Suggestions on the current laws and regulations of ride-hailing in the third part.
