A Study On The Co-governance Model Of Bribery Crime Prevention In Chinese Enterprises

Bribery crime,especially in the commercial field,has a high degree of concealment and universality.Chinese enterprise bribery crime is rampant day by day,and the current crime management mode has fundamental defects.Based on the analysis of the existing means of self-discipline and other governance,this paper puts forward the mode of co-governance of state and enterprise which is suitable for the prevention of bribery crime of enterprises in our country on the basis of reference to the governance of criminal compliance outside the territory.This model is more effective than single self-discipline or heteronomy means in preventing corporate bribery crime,lightens part of the burden of national governance,reduces judicial cost,improves judicial efficiency,and pays attention to the reconstruction of internal compliance culture in enter:prises.This is about the importance of survival for the enterprise.Secondly,the causes and theoretical basis of the co-governance model in the field of criminology and criminal law are described.On this basis,the basic framework of the co-governance model is theoretically conceived,and the criminal law is regulated(punishment,punishment).Incentives)and enterprise compliance put forward specific requirements.Finally,this paper analyzes the local standard of" Shenzhen Standard",which is first put forward by our country,and puts forward some concrete and meaningful suggestions for perfecting the system in three aspects:self-discipline,heteronomy and supporting measures.
