The Application Of Restorative Justice In Taiwan Juvenile Judiciary

Traditional juvenile criminal justice has many shortcomings,and people begin to re-examine the relationship between juvenile delinquency and criminal justice.In juvenile delinquency,whether it is retributive or corrective justice,both pay little attention to the needs of victims and are bad for the rehabilitation of juvenile.To handle the problems,Taiwan tries to introduce restorative justice to juvenile judiciary.Although restorative juvenile justice has made remarkable achievements,it also faces many challenges.Apart from the preface and conclusion,this thesis is divided into three chapters:The first chapter is about the introduction of the restorative justice to juvenile judiciary in Taiwan,which shows the history of juvenile judiciary.From retributive justice to corrective justice,both failed to reduce the juvenile delinquency and care the interests of victims.The introduction handles the problems effectively.The second chapter shows the practical operation and examination of restorative juvenile justice.This chapter introduces the modes of practice and method of trial,and also analyzes the mediation and deferment of prosecution.Secondly,a large number of data show that restorative juvenile justice has gained great results,such as“the number of juvenile suspects has dropped”,“the number of juvenile cases has dropped”and“the party and the others have great satisfaction”and so on.The third chapter,the challenges and prospects of Taiwan's restorative juvenile judiciary.Although the juvenile justice has got great achievements,it is also confronted with challenges,such as“how to understand the juvenile responsibility",“how to understand the juvenile confession”and“the impact of the introduction of‘victim views'on juvenile justice”Finally,the restorative juvenile judiciary should be based on the best interests of the juvenile,fully understand the dual attributes of the juvenile,value juvenile traits,and help them reintegrate better.
