When the first panel report on the large civil aircraft subsidy dispute between European Communities and United States circulated on June 30 2010,it was widely discussed in academia.May 15 201 8,the compliance appellate body report of European Communities and certain member states—Measures Affecting Trade in Large Civil Aircraft(DS316)circulated to members.And the United States—Conditional Tax Incer:ntives for Large Civil Aircraft(DS487)became the first dispute involving prohibitive import substitution subsidies in large civil aircraft industry.China's civil aviation industry is about to enter the international market.With the new development of subsidies in civil aircraft industry,it is necessary to analyze the subsidy rules under the SCM agreement based on the combination of new facts and new csases.This thesis is divided into four chapters,besides introduction and conclusion:Chapter 1 briefly elaborates the basic rules of the SCM agreement,including the three constitutive requirements and classification of subsidies.This chapter explores the definition of subsidies,clarify the relationship between different types of subsidies,and lay a foundation for the next chapter to analyze specific cases by combining theory with practice.Chapter 2 provides a more in-depth analysis of the prohibitive export subsidies that have been widely discussed in every large civil aircraft cases.Since the identification of the"de facto contingency"of export subsidies is the most complex situation,this chapter analyze the conclusions and recommendations of panel and appellate body on typical disputed,focuses on the reasoning logic of the identification criteria.Chapter 3 compares and summarizes the"de facto contingency"identification criteria used by the aforementioned panel and appellate body report then applies them to the analysis of prohibitive import substitution subsidies.This chapter makes a comprehensive analysis and summary of the new prohibitive import substitution subsidies in large civil aircraft industry.Chapter 4 analysis the application of SCM agreement to civil aircraft industry and links it to China's current civil aircraft subsidy policy,so as to put forward suggestions for further improvement.
