Research On The Relationship Between Public Opinion And Legislation

Public opinion and legislation is a group of relations worthy of study.The two are closely linked,and public opinion can be an effective resource for influencing legislation to a certain extent.However,there is not much direct research on the relationship between them at home and abroad,and they are analyzed and explained in an indirect or interdisciplinary manner.This paper analyzes the relationship between public opinion and legislation mainly through the use of case analysis and agenda setting theory.Based on the current domestic public opinion environment and legislation,this paper takes the 184 th article of the General Principles of Civil Law(commonly known as the “good people law”)as an example to analyze its background,disputes and possible follow-up discussions.During the long period of the Peng Yu case,the investigation and analysis of public opinion is carried out.First of all,the article divides the subject of public opinion into media,ordinary people and experts and scholars.The state should be one of the main bodies of public opinion.However,in the case analysis of this article,the analysis of the state subject focuses on the summary rather than separately.Secondly,talk about the performance of each subject in the relationship between public opinion and legislation,the formation of relevant public opinion agenda and its role in the legislative process.Because different public opinion subjects play different roles in the legislative process,they have the value orientation of their own groups,and even there are differences of opinion within the same subject,that is,the mainstream of public opinion and the formation of public opinion tributaries.Different public opinion subjects have mutual influence,there are games and consensus,and the factors affecting this interaction mainly include political,economic,cultural and technological factors.At the same time,the article closely follows the two central points of the Peng Yu case and the 184 th General Principles of the Civil Law.Through the description of the event and the characteristics of each subject,the internal logical connection between the two is connected.The slow legislative impact is different from the short-term,quick-response “stress legislation” brought about by major social public events in the past.In the process of discussion,it is compared with other legislative issues in China.With the increasing diversity of public self-expression methods,the gradual disclosure of legislative procedures,how to truly scientifically legislate,carry forward socialist democracy,give play to the positive role of public opinion,and avoid its negative effects,this article attempts to observe through cases and hopes that the future will have chance to have an in-depth research.
