The judicial system of the Wei,Jin and Southern and Northern Dynasties was a transitional stage of the ancient feudal judicial system in the Qin and Han Dynasties.Therefore,the development of the judicial system in this period has played a key role in the history of the development of the ancient legal system in China and presented its unique characteristics of the times.Some of its characteristics can generally reflect the characteristics of the judicial system throughout China's feudal period.Analysis of its advantages and disadvantages helps us to recognize the true state of justice in our feudal period.First of all,from the perspective of judicial principles,the Wei,Jin,Southern and Northern Dynasties were an important period in which the Confucian spirit and ethics were fully integrated into culture and codification.They basically completed the combination of ritual and law,and the process of ritual law marked the basic stereotype of the Chinese legal system.It laid a solid foundation for the maturity of the Chinese legal system in the Sui and Tang Dynasties.Secondly,in the legislation of the specific judicial system,the Wei,Jin,Southern and Northern Dynasties were a comprehensive summary and improvement of the judicial system in the Qin and Han Dynasties in China,and the exploration and Innovation also laid the foundation for the complete judicial system in the Sui and Tang Dynasties.Again,from the perspective of the judiciary,he Wei,Jin,Southern and Northern Dynasties developed the Ting yi in the Qin and Han Dynasties,and the functions of Ting yi also developed.The appearance of Du guan Shang shu and Dali is the basis for the perfection of the judicial organs of the Sui and Tang Dynasties.This article elaborates on the changes of the judicial system during the Wei,Jin and Southern and Northern Dynasties from the aspects of judicial institutions,the judicial system the judicial administrative system and the evaluation of its changes.The first chapter is the change of the judiciary.The judicial institutions of the Wei,Jin and Southern and Northern Dynasties generally inherited the Qin and Han Dynasties.The central judicial officer is called Ting yi,and the administrative and judicial functions of the local government are mixed.There are local top governors,and the state,county,and county levels are implemented.However,with the changes in the situation,the central judiciary has seen some development.First of all,the Tingyi officials have undergone major changes,forming a new series of Ting Yu qing,Ting Yu Shaoqing,Ting Yi zheng,Tingyijian,Tingyi,and Ting Yu ping.The Judiciary has been enriched and development of.Secondly,there have been some changes in the central judicial administrative system.In the Northern Qi Dynasty,Tingyi was changed to Dali Temple,which has epoch-making significance in the history of China's judicial system.The second part mainly introduces the changes in the judicial system.This paper introduces the judicial system of the Wei,Jin,Southern and Northern Dynasties into two parts:the judicial system and the judicial administrative system.The litigation system during this period mainly consisted of the standardization of the torture system,the need to blame the family for the principle of resignation,the change of the review system,the emergence of the slogan and the lung stone letter in the direct appeal system,the development of the prisoner system,and the death penalty.The development of the review system and the principle of trial of special cases;the judicial administrative system includes the execution system of the death penalty and the detention system.The third chapter is the analysis of the changes in the judicial system.The advanced nature of "Tang Law Discussion" and its influence on neighboring countries and later generations are recognized by the world.The judicial principles and systems of the Tang Dynasty are similar to those of the Wei,Jin and Southern and Northern Dynasties.Therefore,this paper discusses the specific impact of the judicial system on the Tang law in the Wei,Jin,Southern and Northern Dynasties.
