Preferential treatment and pension is an important system under the social security system of our country.The object of preferential treatment and pension is a special social group that has contributed or sacrificed for the country and the people.The preferential treatment is the compensation and reward of the state and society for their sacrifice and contribution.Since the founding of the people's Republic of China,the legislation of preferential treatment and pension has been continuously developed and perfected,and has formed a system with relatively complete standards,levels and projects.However,there are still some institutional defects in the preferential policy of our country,and there are many contradictions and difficulties in the practice.At present,socialism with Chinese characteristics has entered a new era and is in the decisive stage of building a well-off society in an all-round way.Under the new starting point,new journey,and new stage of our country's development,a new pattern of preferential treatment and pension work in line with the level of economic and social development,with the basic social security system,and with the goal of national defense and the modernization of the armed forces is constructed.Only in this way can we truly achieve the development goal of enhancing the well-being of the people's livelihood.It is of great practical significance to study the system legislation and establish a perfect system of preferential treatment and pension for the protection of the basic rights and interests of the objects of preferential care and the maintenance of the overall situation of reform development and stability.This paper takes the legislation of preferential treatment and pension system as the research object,applies the methods of historical research,literature study and comparative analysis,through the basic theory of preferential treatment and pension,the development and evolution of the preferential pension system and the current legislative situation in our country.Based on the analysis and summary of the preferential pension system in developed countries,the countermeasures and suggestions for perfecting the preferential pension system in China are put forward.In addition to the introduction,this article is divided into five parts:The first part is the research and definition of the basic theory of preferential pension system.The author starts from the basic concept of preferential pension,defines the basicconnotation and extension of preferential pension system,clarifies the object scope and guarantee content of preferential pension,and lays a theoretical foundation for further system discussion.In the second part,the author traces back to the history of the system from the germination of the revolutionary war to the beginning of the founding of the people's Republic of China,to the further improvement of the reform and opening up,and summarizes the legalization and nationalization of the development of the system in our country.The trend of monetization and popularization indicates the direction of system construction in the future.In the third part,the author reviews and comments on the current situation of the legislation of preferential care system in China.This part introduces in detail the current provisions of the system structure,pension system and preferential treatment system in our country,based on the central legislation,combined with the specific implementation of Chongqing,summed up the current system in the legislative system,There are institutional defects in four aspects: the level of security,the preferential treatment of spirit and the supervision mechanism.In the fourth part,the author selected the United States and Russia,respectively,from its preferential legal system,institutional settings and characteristics of the system of three aspects of the analysis,reveals the United States and Russia in the legislation concept,legislative system,The enlightenment of the specific system regulation to the legal system construction of our country's preferential care system.In the fifth part,the author considers with the basic national conditions of our country,combines with the background of the reform of the preferential and governing institutions and the legislation of the military Protection Law,respectively,from the transformation of the system concept.The construction of the system and the perfection of the system content respectively put forward the concrete countermeasures and suggestions.
