Operators'right of choice refers to their right to decide their own business affairs within the scope stipulated by laws and administrative regulations.Although there is no explicit provision in the law,the operator's right to choose actually exists in the trading relationship,and many scholars have done a lot of discussion.The choice of the operator includes not only the choice of the mode of operation,the choice of the operating conditions,the choice of the operating characteristics,but also the choice of consumers,because the status of consumers and operators as parties to the contract is equal,which is also out of the consideration of preventing consumers from abusing their rights and establishing a harmonious consumption relationship.However,the operator's right to choose is not without boundaries,and should be subject to certain restrictions,such as legitimacy restrictions,not applicable to specific industries,to meet the public interest and consumers'right to know the selection conditions.
