Family is very important for the socialization for minors and family education is irreplaceable by any other types of education.Parents are the earliest as well as the most important teachers for their children,whose words and deeds have a subtle influence on their children.Old Chinese saying goes that,the son's errors should blame to his father's failure to teach him and a fond mother spoils the son.Family education has a great effect on the growth and development of minors.In recent years,high juvenile crimes,especially the student crimes,gradually gain attention from the law society because of their particularity.Among the many factor for the juvenile delinquency,the lack of family education is the primary reason.However,the juridical status of family education has not been established in legislation.The current imperfect laws and regulations are becoming obvious in incapable prevention of the juvenile delinquency as well as in protection of minors' rights.Apart from the preface and inclusion,this dissertation is composed of three chapters.The preface expounds the background and significance of the subject,the summary of related academic research achievements,research methods and outline.The first chapter states The relationship between parents rights and duties in educating their minor children.Parents as legal guardians of minor children,have duties to monitor,manage and educate its minor children.Parents should educate their children and guide their children to grow up healthily.It is manifested as excessive attention,laissez-faire and rude treatment of underage children if parents fail to fulfill their education obligations or perform their duties properly.This may cause psychological and behavioral problems of minor children easily.They will commit illegal and criminal acts or become the subject of criminal violations.The second chapter analyzes of parents' rights and duties to educate minors.takes the cases of juvenile delinquency as the entry point,sorts out the practical cases and systematically discusses the ten typical cases of juvenile victims in recent years.The empirical analysis found out that the family education is neglected to minors and non-adult victims in aspects like children's character behavior and psychological,legal education and sexual prevention.Education methods and educational content are also unscientific,and even parents' own self-cultivation is not high and lack of legal awareness which harm the pupillus.The third chapter states inadequate protection and perfection of civil law for minor children.Analyzes the non-scientific content of existing laws and regulations related to the minor children,the non-sufficient of specialized subjects to supervise parents' fulfillment of education duties were analyzed,the right to family education is not clear,and suggestions were put out such as designing a complete and unified legislative system for the protection of minors,accelerating national education legislation,establishing a national guardianship system for minors,by referring to the legislative experience of Hong Kong and Taiwan in China.In order to solve the problem of the lack of the access for the acquisition family education knowledge,imperfection of visitation rights system,the insufficient in value conflict of minor children justice practice,we proper the suggestions of improving the parental education system,increasing maneuverability of the visitation right,bring in minor children justice model"light and heavy" to reconcile the value contradiction.
