Research On The Construction Of Judge Cultural In The Context Of Judicial Reform

At present,China's social development needs,has been established to build a socialist country ruled by law,the grand goal,after this,the public will focus more on the focus of justice.Construction of the judge's culture,which is a very important guarantee for the realization of judicial justice.Based on this,many scholars in our country on how to build a suitable for our country's judge culture theory system to carry on the corresponding research.At the same time,the judiciary for the construction of the culture of judges also give the appropriate attention.In 2010,the Supreme People's Court issued "on Further Strengthening the cultural construction of the people's court opinions" on the clear requirements,to actively promote the construction of spiritual culture of the court,and in a fair,honest and for the people of the judicial core values as the guiding ideology of the construction.Based on the above content,whether public demand or the professional community of judges,it is urgent to strengthen the construction of the culture of judges in our country.From a cultural point of introduction of Judge Culture,first part,the judge culture are defined by three levels:psychology,consciousness,value.Judge culture is defined as the sum of judge the behavior of the exercise of national jurisdiction universal restraining effect of various psychological factors.The second part,analysis of the influence and values of traditional judges culture,summarized the problems of our judge culture,e.g for the understanding of the judge culture stagnant,deviation from the objectives of justice,the judge team professional sense of honor is not strong,there is gap in a typical set of judges with epitaxial judge culture,indifferent to ethics awareness of judges,in order to seek targeted solutions to improve the construction of judge cultural.The third part,the main analysis of different judge cultural characteristics of the United States,Britain,Germany and Japan.Despite that the foreign judge cultural vary,but there are still some common characteristics,that legal profession there is a derived from traditional beliefs of the law,appointment of judges and judicial independence linked.Some of these features have a reference for us.Fourth part,from the introduction of the urgency of strengthening construction of judge cultural,construction of judges cultural from both the judge's own inherent and social factors,aimed at cultural construction of our court,to enhance the quality of judicial ethics,ensure justice,and to provide theoretical support path-reference.
