With the development of the market economy and the intensification of the aging of the population in our country,as a new form of labor and employment,the employment after retirement has been widely used in various fields.However,the current legislation and judicial protection of the rights and interests of the special employment groups have not been clearly defined by law.On the current statutory retirement age,currently has no dispute,but in practice about retirement employment legal status,employment,property law and the protection of the rights and interests of the injured have obvious differences,directly affect the protection of labor rights groups especially for protection of the rights and interests of the injured workers.In order to stimulate the favorable side of the aging of the population,to face up to the diversified development of labor market in China,and to develop the national economy,we must protect the rights and interests of the injured workers.Because of the difference of the lack of legislation and judicial of the group due to work injury disputes occurred frequently and not resolved,especially the qualitative analysis on the identity of the blurred or even all legislative bodies out of the policies and regulations,the judicial organs around the guidance are fighting each other is not uniform,resulting in the group due to the injury at work can not be in accordance with the ordinary workers easily related injuries,a direct result of its rights and interests,which seriously affects the labor relations,and the damage to the structure of the labor market,and ultimately hurt the national economy,cannot enjoy the population aging due to the favorable side,on the issue of unified legal regulation and government and guide enterprises to fulfill their social obligations as imminent.
