Research On Legal Issue Of Non-martial Cohabitation Of The Senior C Itizens In China

One of the difficulties in the legislation of relatives is to "respond to social concerns and provide a solution to the new situation and new problems of marriage and family relations".The senior citizen in China choose the non-marital cohabitation as their future life style when they face the worldwide problem called "silver wave",but there are some"negative influence" in this choice.In the dispute cases of the senior citizens' cohabitation division,the problem is focus on property ownership,inheritance and maintenance.However,the existing legal provisions cannot well resolve these issues and are not conducive to the protection of the rights and interests of the senior citizen.Through the study of the legal issues involved in the case of the senior citizens' non-martial cohabitation,the necessity of perfecting the legislation related to the non-marital cohabitation of the senior citizen is explained.Based on respecting the freedom of the senior citizen to choose their lifestyle,thinking of legal countermeasures for the non-marital cohabitation of the senior citizen in China is proposed.It is conducive to preventing and reducing cohabitation disputes and protecting the legitimate rights and interests of the senior citizen.Non-martial cohabitation itself is extremely unstable,and there are varied of reasons why the senior citizen choose the lifestyle.In view of this,the full text is divided into five parts.The first part is an overview of the senior citizens' non-marital cohabitation,which shows that the senior citizen is different from other subjects as the subject of non-marital cohabitation,.The second part,through the analysis of typical cases of non-marital cohabitation of the senior citizen,combined with the current situation of non-marital cohabitation of the senior citizen in China,puts forward the legal issues involved in the current senior citizens' non-marital cohabitation cases in China.The third part analyzes the reasons for the legal problems of the senior citizens' non-marital cohabitation from the legal perspective of non-marital cohabitation,remarriage and old-age services.The fourth part,from the perspective of theory and reality,illustrates the necessity of perfecting the legislation related to the senior citizens' non-marital cohabitation in China.The fifth part,based on the legal issues of the senior citizens' non-marital cohabitation and the reasons for its formation,puts forward the legal countermeasures for the senior citizens'non-marital cohabitation in China,in the hope of contributing to the construction of related systems such as the protection of the rights and interests of the senior citizen in China and enlightening the improvement of legislation of relatives."elderly and children" is the biggest livelihood of the people.If the senior citizen has a happy old age,the later generation will have a promising future.Starting from the legal perspective of non-martial cohabitation,remarriage and old-age services,this paper proposes the legal countermeasures for the senior citizen non-marital cohabitation in China.On the one hand,it fully respects the freedom of the senior citizen to choose their lifestyle,so that the senior citizen can autonomously choose remarriage and the way of socialized pension without the worries behind.On the other hand,even if they are forced to choose non-marital cohabitation,they can protect themselves to the maximum extent.The study of the legal issues of the senior citizen non-marital cohabitation has a very positive practical significance for breaking through the current plight of China's pension,and seeking a way out for the senior citizen in China:First,it is conducive to preventing cohabitation disputes and protecting the legitimate rights and interests of the disadvantaged elderly.Second,it is conducive to defending family stability and respecting the lifestyle choices of the senior citizen.Third,it is conducive to maintaining social welfare and reducing the legal risk of pension services.
