Study On The Good Governance Of Marine Legislation In China

The sea occupies 71%of the surface,connects the various continental plates,is the bridge of communication between the major plates,and has an extremely important role and significance for people's survival and development.However,human activities and climate change have put enormous pressure on the oceans and seas,and the United Nations has continuously referred to the strengthening of global ocean governance,the international community's attention to this is increasing.China occupies a favorable position in global ocean governance,has its saying in this regard and should do a good job in the "security" work,pay attention to the construction standardize the process of ocean governance,clarify the main body and responsibility of ocean governance,pay attention to the change of ocean governance mode,strengthen the supervision and management of marine fisheries,maritime traffic safety and so on,and increase the intensity of marine scientific research.In order to understand the problems existing in the legal system of ocean governance,and to discuss how to improve the level of ocean governance in China,this paper analyzes the legal aspects of the legal system of sea-related law in China from the connotation requirements of the eight essential elements of high-quality ocean governance through literature research method and word frequency analysis.The full text is divided into five chapters,The first chapter is the introduction,which introduces the research background,research methods,research significance and literature review.The second chapter describes the direction of ocean governance in present day,including the goal of sustainable development of the oceans and seas:in the 2030 Sustainable Development Agenda,the construction of the Blue Partnership,etc.,discusses the connotation of "governance","Ocean Governance","Global Ocean Governance",according to the report of the Secretary-General of the United Nations,this research points out the hot issues of global ocean governance,and then discusses the connotation of "high-quality ocean governance" or "good governance of the oceans",and analyzes the embodiment and requirements of the eight elements of quality ocean governance at the international level by enumerating international law or relevant treaties and customs;The third chapter is an important part of this paper,describes the existing legal system of ocean governance in China,from the constitutional,law and regulation levels to point out China's ocean related and regulations,and then discusses China's ocean governance legislation,discussed in detail the connotation of the eight elements of high-quality ocean governance requirements,and according to its requirements may be expressed in the law,This study analyzes the law of 17 cases involving sea law,determines the performance of the high quality ocean governance elements at the legal level of sea-related law through the frequency of words,and makes a concrete analysis of the performance of the law of the relevant authority,and obtains how the law of the sea concerned has done what are the problems.In the fourth chapter,the study summarizes the legislative problems in embodying the "good governance of the sea" in the legal level of the sea involved in China,and puts forward some suggestions on the existing problems.The five chapter makes the conclusion of this paper.The innovation of this paper lies in the detailed discussion of the connotation and requirements of the eight elements of high-quality ocean governance,a more comprehensive review of China's sea-related legal legislation,but there are still shortcomings such as the deviation of personal understanding in the process of law screening.
