The 21st century is the century of the oceans. The oceans are very important to the process of achieving China’s Dream. China has more than 3 million square meters sea land, but a half of them are involved with disputes between other countries. To safeguard the marine rights on the basis of law is the duty and obligation of China’s government. But trapped by the mechanism which is managed by many separated departments, China’s marine rights transactions are always in the predicament, which can not form resultant force, repeat inspections and constructions. And the law enforcement efficiency is not high, lack of enough ability to safeguard rights.In March 2013, the National People’s Congress passed the program about the transformation of the institutional and functional reform of the State Council. The program allege the integration of Surveillance, Fisheries, Coast guard of public security police, Anti smuggling police of the customs, these law enforcement forces will be unioned by restructuring the State Oceanic Administration. The State Oceanic Administration will safeguard marine rights in the name of China Coast Guard Bureau at sea.This research is based on the writer’s personal involvement in the maritime law enforcement forces conformity reality. From overall perspective of governance theory, it analyzes the present situation and development of marine rights challenge, ocean rights protecting mechanism of China. Compared the marine rights mechanisms of the United States, Japan and Korea, it concludes the characteristics and advantages of the 3 countries,the enlightenments to China’s construction of advanced marine protection mechanism as well. Finally, with the application of holistic governance theory, the paper attempts to put forward a way to construct China’s marine rights protecting mechanism.
