Today's digital trade relies on the freedom and openness of the Internet,leading the development of global economic.Countries seize opportunities,optimize domestic digital industries,develop digital trade development strategies,and try to occupy the dominant position in the development of digital trade rules.The digital economy also brings opportunities for developing countries.In the context of the weak global economy,developing countries,including China,should make full use of the advantages of digital economy,to promote the optimization and upgrading of the domestic digital industry structure,and reduce the gap between developed countries.However,the conflict of interest group caused by this has led to the lack of a set of scientific and complete dispute resolution systems in digital trade area.Although the multilateral trade agreements led by Europe and the United States are driving the development of digital trade rules,only a few areas of consent have been reached,far behind the needs of practice.The formulation of digital trade rules is not only a conflict of commercial interest distribution,but also involves a series of complex national sovereignty issues,national security issues,privacy issues,technical issues,infrastructure issues,etc.Which results in digital trade barriers,including cross-border data streaming,digital localization,cybersecurity,intellectual property,electronic signatures,etc.It has added many destabilizing factors to the negotiation and formulation of international rules for digital trade.Therefore,without the authoritative and unified digital trade rules,China should promote the digital transformation of domestic industries and actively formulate high-level digital trade rules to create new impetus for economic development.The text is divided into three parts.The first part describes the current state of digital trade and its implications for global economic development.The second part analyzes the international rules of digital trade,including four points.The first point is about the major multilateral and bilateral trade agreements on digital trade.It first analyzes the digital trade rules between CPTPP,TTIP and TISA,and then describes the bilateral economic and trade agreements in which China participates.The bilateral economic and trade agreements in which the United States participates,and the bilateral economic and trade agreements in which the EU participates,and finally compare and analyze the overall model of existing digital trade rules.The third part deals with the main differences in the international rules of digital trade,:including disputes under the WTO framework,free flow of cross-border data,protection of personal information,and disputes over the intellectual property system.The fourth part describes the enlightenment of China's development of digital trade rules to promote the development of digital industry.
