Research On Legal Regulations Of Health Management Organizations

Against the background of aging population,increasing mortality rate of chronic non-communicable diseases,and increasing number of sub-healthy people,health management consumption shows an explosive growth trend.For a variety of reasons,when health management services improve people's health conditions,the problems gradually arise at the same time.China's health management industry has developed less than 20 years,and the research on the legal regulation of health management organizations started late.A large part of the norms are scattered in other laws,regulations and rules,and there is no targeted legislation.The law enforcement and supervision mechanism and industry self-discipline mechanism for the operation of health management organizations are also very imperfect,which makes the relevant regulations unable to be implemented.Health management has been developed for a long time in the United States,Germany,Japan and other countries.Their systems of health management organizations are more mature and comprehensive,which have important reference significance for the improvement of the operation system of health management organizations in China.By sorting out the basic knowledge of health management and health management organizations,this paper studies several universal and representative problems in the operation of health management organizations through cases.Based on the comprehensive analysis of the relevant systems of foreign health management organizations,combined with the actual situation of China,this paper puts forward Suggestions on perfecting the regulation system of China's health management organizations from the aspects of the composition structure of different health management institutions,laws and regulations,administrative supervision,industry self-discipline and consumer rights and interests relief.This paper is divided into four parts.The first part introduces the basic knowledge of health management and health management organizations.Firstly,this paper defines the concept of health management,and distinguishes the differences between modern health management and traditional health management,China's health management and foreign health management.Then it studies the development trend of health management in China and the national policy planning for health management.In the part of health management organizations,the development status of health management organizations is discussed mainly from two aspects: the type of health management organizations and the content of service.The second part studies the dilemma of the health management organizations' operation in China.This part builds on the basis of analyzing the related cases,and selectively explores the four universal and typical problems,including the problems of the organization structure of health management organizations,employee allocation,personal health information protection and false advertising in the process of service provision in China.The third part studies the operation system of health management organizations abroad.This part firstly discusses the operation mode of foreign health management organizations,which is closely related to the applicable legal system.Secondly,it studies the legislation,supervision,industry self-discipline mechanism and other systems of the United States,Japan and other countries,which has great reference value for China.The fourth part is to propose the path choice of legal regulation for health management organizations in China.Firstly,this part explores the rational structure of different health management organizations;Then it puts forward some legislative Suggestions related to health management institutions;The measures to optimize administrative enforcement and supervision of health management are also considered;In addition,there are some suggestions on self-regulation of health management industry,such as strengthening brand building,legislative suggestions related to health management organizations;Finally,it explores the ways of health management to relieve consumers' rights and interests,including improving consumers' awareness of rights and interests protection and realizing diversified dispute resolution.
