Research On The Legal System Of Non-legal Punishment Right Of Trade Associations

At present,China's society is in the context of political and economic reform and the decoupling of trade associations from administrative organs.Trade associations have gained opportunities for rapid development,providing impetus for safeguarding the interests of their members and promoting the healthy development of the industry.Trade associations,by formulating self-governing norms within their own industries and according to these norms,impose corresponding restrictions and penalties on the behavior of their members,which is an important means of safeguarding the interests of trade associations and stabilizing the order of associations.Trade associations have autonomy in their own industries,and the non-legal punishment right of trade associations is an essential and vital part of the autonomy of trade associations.The exercise of non-legal punishment right of trade associations is conducive to the implementation of the self-governing charters of trade associations,to preventing free-riders among members of trade associations,and to remedying loopholes in legal punishment.However,while the non-legal punishment right of trade associations in China plays a certain role,there are still many problems,such as unclear exercising subject,imprecise punishment content,lack of internal and external relief system and imperfect procedural provisions,which will affect the effective role of trade associations in practical activities.Therefore,this paper demonstrates the legal issue of the non-legal punishment right in the autonomy of trade associations.Firstly,it introduces the basic theory of the non-legal punishment right of trade associations,explains its concept and theoretical basis,and then analyses the current situation of the non-legal punishment right and the legal system of the non-legal punishment right of tradeassociations in China,and then elaborates the exercise of the non-legal punishment right.There are some shortcomings in the process of non-legal punishment right.Then,according to the advanced experience of foreign countries,we summarize the enlightenment to the development of trade associations in our country.Finally,we put forward the corresponding improvement measures according to our national conditions.In order to promote the healthy development of trade associations,this paper not only sticks to the domestic theoretical research level,but also investigates the development of foreign trade associations in order to draw lessons from their advanced experience and practice in China,and puts forward the following immature suggestions,such as clarifying the main body and scope of the exercise of the non-legal punishment power of trade associations.Make procedures,improve the relief mechanism of trade associations and so on.
