Legislative Model Change Under The Influence Of Cyber Collective Behavior

In the information age,the society is changing and developing rapidly,and the structural contradictions are prominent.At the same time,the way of human communication and communication has undergone revolutionary changes,and the cost of public opinion expression on the Internet has been decreasing day by day.Based on such conditions,network aggregation behavior as an important form of public resistance occurs frequently,and has an important impact in the field of legislation.Network aggregation behavior can gather public opinions in a short time,forming a strong pressure situation,pushing the legislative body to promote legislative reform from bottom to top,forming a pressure-type legislative phenomenon.This is an abnormal legislative phenomenon in the period of social transformation,which plays a connecting role in the reform of legislative mode.On the one hand,it makes it possible for the public to push forward the legislative reform from bottom to top,reflecting the increasingly important development trend of the public as the main body of legislative needs in the legislative pattern,breaking the elite-led democratic legislative model.On the other hand,the phenomenon of pressure-type legislation shows the importance of public rational participation in legislative activities through its own defects,such as uneven legislative quality and weakening legal authority,and promotes the shift of legislative mode to cooperative democratic legislative mode focusing on rational communication and negotiation between subjects.This article will be based on the process of transforming from elite-led democratic legislative model to cooperative democratic legislative model,combining with specific cases,in-depth analysis of pressure-based legislative phenomenon,and then summarize the role of network aggregation in the legislative model reform,and put forward corresponding suggestions on the concrete construction of cooperative democratic legislative model.The first part of the paper mainly analyses the legislative model of elite-led democracy and its defects.This part is based on the combing of elite theory,combined with the specific legislative practice of our country,in-depth analysis of the background and defects of elite-led democratic legislative model.The second part of the paper mainly introduces the phenomenon of pressure legislation.This part mainly starts with the specific cases of the pressure-type legislation formed by the network aggregation behavior,and introduces the pressure-type legislation phenomenon from five aspects: connotation,characteristics,manifestation,motivation and influence.Firstly,the concepts of network aggregation behavior and pressure legislation and their relationship are analyzed.Secondly,based on the specific cases of pressure legislation formed by network aggregation behavior,the characteristics and manifestations of pressure legislation are further explained.Then,the causes of pressure-based legislation are comprehensively and thoroughly analyzed from the various elements of participation.Finally,according to the different manifestations of pressure-based legislation,the positive and negative effects are analyzed.The third part of the paper mainly discusses the cooperative democratic legislative model and its construction.Firstly,this part puts forward the concept of cooperative democratic legislative model from the perspective of institutional change,and deeply analyses the motivation of cooperative democratic legislative model from the social structure,the relationship between the state and society,and the concrete manifestations of all parties.Finally,the concrete construction of cooperative democratic legislative model is discussed from three aspects: improving the information ability of legislative subjects,giving full play to the role of the media as a link and improving the public's legislative participation.The fourth part of the paper mainly analyses the influence of network aggregation behavior on the change of legislative mode from the specific process of the change of legislative mode.In the process of the transformation from elite-led democratic legislative mode to cooperative democratic legislative mode,the pressure-based legislative phenomenon is the node of the legislative mode reform,and the network aggregation behavior is the pivot of the legislative mode reform.This part is based on the above explanation of specific legislative mode,trying to sort out the process of legislative mode transformation,and further investigate the impact of network aggregation behavior on legislative mode transformation,as well as the deep-seated reaction in the process of legislative mode transformation.
