Due to the rapid economic and social development and the intensification of social conflicts,the " litigation explosion" phenomenon has become the norm,which has led to the prominent contradictions such as a large number of cases,a shortage of judicial resources,the overload of judicial personnel,different judgments on the same case,etc.At the same time,with the deepening of the construction of the rule of law in our country,ordinary people also have more expectations for fairness and justice.Faced with these problems,traditional thinking can no longer meet the needs of reality,so we can turn to new scientific and technological achievements-artificial intelligence.The introduction of artificial intelligence technology into the field of judicial adjudication may provide us with some new ways to solve the problem.The research and application of artificial intelligence technology has already set off a climax in our country.The explosive growth of legal data has prompted artificial intelligence to deepen from the research on general issues to the legal field.Under the national strategy for the development of artificial intelligence and the call of the " 3.0" intelligent court,judicial organs in all parts of our country have established their own artificial intelligence case handling systems in order to seek a comprehensive and in-depth integration of artificial intelligence technology and trial work,and accelerate the modernization and automation of the trial system and trial capability.Up to now,the construction of weak artificial intelligence has taken initial effect in our country's judicature,mainly reflected in legal information retrieval and legal expert system,which greatly improves the quality and efficiency of handling cases.At present,the application practice in our country is in the transition stage from weak artificial intelligence to strong artificial intelligence.In an ideal state,artificial intelligence can rely on its own strong advantages to simulate the judge's judgment and become an auxiliary tool for judges to judge cases,making the judgment become an intelligent man-machine cooperation mode,so as to improve judicial efficiency,promote the realization of fairness and justice,and rationally allocate the limited judicial resources.At the same time,we need to pay more attention to how to achieve the goal of judicial fairness and justice to the greatest extent when artificial intelligence technology is introduced into the field of judicial adjudication.The development of artificial intelligence is facing certain practical difficulties,and there is still a huge gap between theoretical possibility and technical feasibility.First of all,we should make clear the orientation of artificial intelligence in the field of judicial adjudication,which is an auxiliary tool to help judges judge cases and should not replace the judge's own effectiveness in judging cases.Secondly,from a technical point of view,as the core of artificial intelligence technology,algorithms also bring some challenges,such as " black box" of algorithms and accountability issues.In addition,from the perspective of talents,the legal person and the technical person have not been deeply combined,and the lack of compound talents will make the fusion research about artificial intelligence technology in judicial trial stop.Finally,at present,the legal data necessary for artificial intelligence is not comprehensive,and the challenges to judges' independent jurisdiction and legal system,especially the response to difficult cases,are still short of research.Based on a brief introduction of the current situation of judicial adjudication practice,this paper explains the concepts of artificial intelligence and judicial artificial intelligence,and then analyzes and concludes that the application conditions of artificial intelligence in the field of judicial adjudication are not yet mature.It also attempts to put forward corresponding strategies in the aspects of constructing a unified judicial database,establishing the principle of final adjudication of judicial workers,developing compound talents,and standardizing the algorithm system,so as to provide ideas for the relevant problems encountered in the deep fusion of artificial intelligence technology and judicial trial...
