Research On The Spirit Of Honesty In Huizhou Commercial Law Culture In Ming And Qing Dynasties

Huizhou merchants had been dominant in Chinese history for hundreds of years.By the Ming and qing dynasties,huizhou merchants had rapidly developed into the largest commercial gang in China and made many achievements in commercial history.Huizhou merchants can achieve such a result,known in the world,spread so far,with its establishment and has a strong and relatively complete commercial legal culture is closely related.Commercial legal culture mainly includes three aspects: commercial regulations,folk family regulations and industry norms,among which the spirit of integrity in commercial legal culture always shows and runs through,playing a vital role.Some contents in the two books,a study of huizhou merchants' legal culture edited by huang mingshu and the spirit of huizhou merchants edited by zhu wanshu and xie xin,reflect the spirit of honesty and practice of huizhou merchants.Taking the two books as the main materials and combining with the local records of six counties of ancient huizhou and other historical books,this paper studies the spirit of integrity in huizhou commercial law culture of the Ming and qing dynasties from the perspective of the spirit of integrity of huizhou merchants.The thesis consists of three parts: introduction,text and conclusion.In the introduction part,the author briefly introduces the reasons of the topic selection,literature review and research ideas and methods.The conclusion part is the summary of the whole paper.The body part is the core part of the article,which is mainly divided into the following three parts:The first part: the ideological root and realistic foundation of honesty spirit in huizhou commercial law culture of Ming and qing dynasties.This part mainly from two aspects the causes of huizhou merchants spirit of good faith and the background,this paper discusses the Confucian ethics,xinan neo-confucianism and the concept of "new said four people" trigger a change in thinking of hui spirit of good faith,the influence of the analysis of the Ming and qing dynasties business economic policy adjustment and the growth of awareness of law and contract for hui spirit of good faith and the influence of the enlightenment.The second part: the connotation of honesty spirit in huizhou commercial law culture in Ming and qing dynasties.This part is the core of the paper.It is mainly divided into the following three aspects,namely from the Ming and qing dynasties huizhou commercial legal culture in the commercial regulations,family rules and industry norms of huizhou business spirit of the basic connotation,concrete practice and historical role,etc.Among them,the business regulations embody the spirit of good faith of huizhou merchants from three different angles: commercial custom,commercial contract and commercial dispute settlement.On the basis of the integrity records county annals recorded in the ancient book of hui,combination of huizhou merchants related records of business requirements and specific case,introduction of commercial law culture of huizhou merchants in the understanding of the spirit of good faith,learning,use and handed down the attention of the education,etc,further expounds huizhou merchants in business management and market transactions how to uphold the spirit of good faith to treat customers,competitors and partners,and other specific aspects of the world.The third part: the realistic significance and enlightenment of honesty spirit in huizhou commercial law culture of Ming and qing dynasties.This part expounds the spirit of good faith as an important part of the spirit of huizhou merchants,which plays a rich and substantial role in the spirit of huizhou merchants.On this basis,it summarizes the influence of the spirit of good faith of huizhou merchants on the commercial ethics of today's society and the practical value and enlightenment of constructing the system of good faith.
