With the development of the financial consumer market,many financial sectors such as banks,securities,insurance,and trust infringe the rights and interests of financial consumers.The main reason for this phenomenon is that financial institutions have used their own advantages to form monopolistic platforms and markets.In financial activities and even in financial disputes,they have used strong bullying to subvert the interests of financial consumers.In response to this infringement,the main measure adopted by China at present is the use of administrative measures to strengthen the supervision of the financial industry,supplemented by the Consumer Protection Act to safeguard the specific rights and interests of financial consumers.However,regardless of industry supervision or the"Consumer Protection Law",the methods are all directed at individual cases.Financial consumers directly request financial institutions to seek compensation to achieve protection.This mode of palliative treatment cannot truly solve financial consumers.The question of equity.Drawing on the experience of the United States and Australia in dealing with this issue,we will combine antitrust and financial consumer protection in the legal system and institutional setup to resolve this contradiction from the source.Therefore,in order to fundamentally protect the rights and interests of financial consumers,China must break the monopoly,strengthen competition,adopt a competition-promoting supervision approach,establish a mechanism of anti-monopoly and consumer protection linkage,and build anti-monopoly institutions and consumption from administrative enforcement.The joint protection mechanism of the protection agencies forms a structural protection system.
