Webcast is an Internet-based multimedia communication technology that delivers real-time messages to the public in the form of graphics,audio and video,and a new form of communication that communicates and interacts online.It has important media attributes of “instant” and “interaction”.In recent years,with the rapid development of mobile Internet and the popularity of smart phones,live broadcast platforms and anchors are getting hotter and hotter.As a new format of the Internet industry,webcasting shows a trend of development of mobility,platform and community.The live broadcast of the show,live broadcast of the game to the development stage of the national mobile live broadcast and pan-entertainment "live +",further promote the prosperity of the "Internet +" economy.However,China's webcasting industry faces inherent contradictions of short development time and rapid development.Due to the lack of timely and effective supervision,the soft spot of the live broadcast market is exposed to the spotlight.In the past few years,in the face of the skyrocketing capital of the live broadcast industry,many online live broadcast platforms have fallen,violations of the legitimate rights and interests of others,harm to the public interest and national security,etc.,have occurred on the edge of morality and law.,constantly challenge the bottom line of the public.In the face of numerous chaos caused by the live broadcast industry,the State Administration of Cyberography,the Ministry of Culture,the State Administration of Radio,Film and Television and other relevant regulatory authorities have successively issued a series of management documents for the live broadcast industry,such as the "Internet Live Broadcasting Service Regulations" and "Internet Audiovisual Program Services".The “Regulations on Management”,“Provisional Regulations on Internet Culture”,etc.,the illegal phenomenon of live webcasting can be strongly curbed and maintain the high pressure on the regulation of the live broadcast market.However,the above provisions can only "treat the symptoms and not cure the problem",and can not fundamentally solve the various problems in the live network of the Internet.The industry supervision faces the lack of legal basis,the rigidization of the regulatory methods,etc.Webcasting brings huge challenges.In view of this,this paper analyzes and analyzes the status quo and problems of online live broadcast regulation,compares and analyzes the regulation mode of Chinese and foreign webcasts,clarifies the objectives and principles of China's online live broadcast regulation,and puts forward specific suggestions for improving China's online live broadcast regulation.The first part of this paper first describes the development status of the network live broadcast industry,combs and analyzes the risks existing in the field of webcasting,and challenges due to the limitations of the current laws and regulations.The second part of the thesis mainly expounds and analyzes the current situation and existing problems of China's online live broadcast regulation,and introduces the necessity of the reform of the network live broadcast regulation.The third part of this paper mainly expounds the status quo of online live broadcast regulation in extraterritorial countries,compares and analyzes the different choices of Chinese and foreign webcast regulation modes,and provides direction for China's online live broadcast regulation reform.The fourth part of the thesis mainly discusses the objectives and principles of China's online live broadcast regulation,and puts forward some suggestions for the network live broadcast regulation in China,so as to construct and improve the network live broadcast regulation system and framework in China,and promote the healthy and stable development of the network live broadcast industry.
