The Impact Of Labor Contract Signing On Migrant Workers' Overwork

With the transformation of China's economy and society,a large number of agricultural laborers began to engage in non-agricultural employment,thus forming a special group in the non-agricultural employment market-migrant workers.Due to the low level of human capital and the division of household registration,migrant workers are mainly engaged in lower-level work and lower wages.Therefore,a large number of migrant workers increase their income by increasing working hours,and the problem of excessive labor is serious.In fact,China's "Labor Law" has made relevant provisions on working hours and overtime pay for laborers.The Labor Contract Law also requires enterprises to sign labor contracts with workers to clarify the working hours and overtime wages of workers.The signing of the contract may help the regularization of the working hours of migrant workers and ease the excessive labor of the migrant workers.In addition,the signing of labor contracts guarantees the employment stability of migrant workers and reduces the cost of unemployment within a certain period of time,and also helps to alleviate the excessive labor of migrant workers.Therefore,paying attention to the impact of labor contract signing on the excessive labor of migrant workers not only helps us to deepen our understanding of the excessive labor choice behavior of migrant workers in the labor market,but also can ease the government's excessive labor related policies and regulations from the perspective of labor contracts.Provide reference for development and adjustment.Although the current research on excessive labor has taken into account the impact of labor contract signing on the excessive labor of migrant workers,the relevant research only focuses on the fact that the labor contract signing may help the laborer to relieve the excessive labor,and does not deeply analyze the labor contract signing.The mechanism of influence on laborers' excessive labor is less concerned with the direct mitigation effect of labor contract signing on the excessive labor of migrant workers.Based on the data of the dynamic monitoring survey of the floating population in 2016,this paper analyzes the impact of the labor contract signing on the probability and degree of overwork ofmigrant workers,and puts forward the policy recommendations related to the labor contract to alleviate the excessive labor problems of the migrant workers.Firstly,according to the data of the dynamic population monitoring survey in 2016,the overwork selection equation of migrant workers was established,and the sample selection bias correction model based on the propensity score regression adjustment was used to analyze the impact of labor contract signing on the excessive labor choice of migrant workers.The research results show that the signing of labor contract can significantly reduce the probability of migrant workers' excessive labor choice,and compared with the male migrant workers group,the labor contract signing has a greater impact on the excessive labor choice of female migrant workers,and the labor contract signing makes the male migrant workers overwork.The probability of selection decreased by 0.26%,which reduced the probability of female migrant workers' excessive labor selection by 0.31%.By comparing the enterprises of different ownership types,it is found that the labor signing rate of the individual industrial and commercial households is the lowest,and the labor contract signing has the greatest mitigating effect on the probability of excessive labor choice of the individual industrial and commercial households.Secondly,the model of migrant workers' excessive labor degree and the working time model of migrant workers are established to analyze the impact of labor contract signing on the excessive labor level of migrant workers.According to the working time,the degree of excessive labor is divided into: moderate labor,mild excessive labor,severe excessive labor,and the sample selection deviation correction model based on regression adjustment is applied to analyze the impact of labor contract signing on the excessive labor level of migrant workers;The linear regression model of regression adjustment is used to analyze the impact of labor contract signing on the excessive labor time of migrant workers.The unconditional quantile regression model is applied to analyze the impact of labor contract signing on the working hours of migrant workers at different working time points.The research results show that labor contract signing can significantly reduce the excessive labor level of migrant workers,and the labor contract signing has a greater impact on the excessive labor level of female migrant workers than the male migrant workers group;labor contract signing can significantly reduce the excessive labor of migrant workers.Time,reduce the overwork timeof male migrant workers by about 1.96 hours,reduce the excessive labor time of female migrant workers by about 2.80 hours;at different working time points,the reduction of the working hours of labor contracts on the working hours of migrant workers shows a trend of increasing first and then decreasing.And the strongest excessive labor limit is about 62 hours,which is the strongest,which is basically the same as the longest working time of laborers defined by China's labor law.It shows that the labor contract signing labor time limits the working hours of migrant workers significantly reduces the degree of migrant workers' excessive labor..Therefore,while strictly implementing the Labor Contract Law,on the one hand,government departments should strengthen supervision over enterprises,and urge enterprises to sign labor contracts with migrant workers,especially to increase supervision over the signing of labor contracts for migrant workers in individual industrial and commercial households;On the other hand,it is necessary to increase the publicity of law-enforcement for migrant workers and raise the legal awareness of migrant workers.These measures will help alleviate the excessive labor of the migrant workers and help promote the sustained and healthy development of the Chinese economy.
