As sharing economy is developing rapidly,enlarging its scale gradually and having wider influence,online short-term rent of housing,which is one of the modes of sharing economy,has presented an explosive growth in our country since 2015.It has not only brought economic benefit but also has provided convenience in travelling and accommodation for the public,besides,it has presented problems as well.As an innovative form,online short-term rent of housing should attract attention and emphasis from lawmakers from perspective of law,which should be regulated and protected by laws.However,there is no suitable laws to regulate this industry in our country currently,but instead,the State Council and national ministries generally adopt the mode of giving guidance to encourage the development of sharing economy and related industries without specific laws and regulations.This industry is still in the “grey zone”,besides,the legal positions of subjects and the legal relationship among them is not clear,as a result,various problems emerge in endlessly.Therefore,this research is of certain research value and practical significance.Based on summary of related researches in domestic and overseas,this paper firstly starts from the essence and characteristics of sharing economy and online short-term rent of housing to analyze the concept and characteristics of sharing economy and form macro cognition on this industry,secondly,this research bases on the concept,characteristics and mode of online short-term rent of housing to analyze the legal relationship among various subjects and form overall and systematic cognition thus to lay a foundation for related researches.Thirdly,this research sorts out the policies and legal environment for online short-term of housing through organizing related legislation situations of online short-term of housing,and introduces related practical conditions briefly thus to carry a foreshadowing of the following contents from macro and micro perspectives and summarize the following problems,such as unclear rights and obligations of online short-term of housing,defects in market entry standards of online short-term of housing,insufficiency in supervisor subjects and modes as well as imperfect taxation regulations and credit mechanism.Finally,this paper bases on the above-mentioned contents to propose related suggestions on laws and regulations of online short-term of housing,specify the rights and obligations of various subjects,establish market entry system,effective supervision system and related supporting system for online short-term housing.The legal problems existed in online short-term housing reflect the lag and blank of laws inemerging social relationship and economic mode.Therefore,it is needed to face the problems,make innovation and persist in incentive and constraint combination to guarantee economic and social operation well in our country thus to create vital environment for economic operation and legal institution establishment in our country.
