In the context of the third industrial revolution of "Internet + artificial intelligence",the global unmanned vehicle technology has developed rapidly in recent years,and there are huge commercial values and core technical secrets that can capture the global market,which has led to the introduction of developed countries.Laws,regulations and policies escort their development and provide an institutional basis for their ability to take the lead in global markets.Among them,the driverless cars in some cities in China have entered the road test stage.However,the development of unmanned vehicles in various parts of China is uneven.In terms of administrative law: the road test system is not perfect,and road access rights and safety technical standards are not given.There are no market access conditions and procedures for driverless vehicles,and lack of supervision and management system for driverless vehicles.In civil law,the main body responsible for driverless car accidents in China is unclear,the responsibility distribution is not specific,and there is no insurance legal regulation.The risks of cyber security and privacy leakage increase;in criminal law,it is necessary to further explore whether driverless cars can be used as the subject of criminal responsibility,and whether passengers can be included in the scope of traffic accidents.The development of driverless vehicles,while posing challenges to the current legal system,on the other hand,lacked corresponding legal regulations,which made China's driverless cars once caught in a very competitive situation.The development of driverless cars in China wants to open up the Chinese market,increase openness,grow rapidly in interna tional competition,how to carry out appropriate legislation,solve the challenges of driverless cars to the current legal system,and exert administrative,civil and criminal laws.The production of regulations makes the development of law keep up with th e advancement of science and technology,and the realization of the regulation and guidance of the development of science and technology is an urgent problem to be solved in China's driverless cars.This paper aims at constructing the legal regulation syst em for driverless vehicles.Based on the literature of the past five years,combining the development and regulation of local cities,and comparing the legal regulation strategies outside the domain,this paper demonstrates the related concepts and foundations of driverless vehicles in China.The theory,through the review of the development history of China's driverless vehicles,analyzes the local practice and legal challenges faced by China's driverless vehicles,and at the same time,the overall situati on of the pilot test area for driverless vehicles and the current status of typical pilot cities.Explain and point out the problems existing in the pilot to demonstrate the objective and realistic needs of the construction of the legal system for driverless vehicles in China.Through the analysis of the legal regulation of driverless vehicles in typical developed countries outside the region,it is worthwhile for China to learn from.Some of them have been refined and summarized.On the basis of the above research,the legal regulation of driverless cars in China is proposed.In general,it includes the administrative and legal regulation of driverless cars,the civil legal regulation of driverless cars and none.Criminal legal regulation of driving a car For the most part,the study draws four conclusions: First,the current law should clarify the legal status of driverless cars and determine whether to grant legal subjects;second,it is necessary to resolve the existing laws and regulations related to driverless cars.The contradiction needs to amend relevant laws and regulations.Third,in order to ensure the safe operation of driverless cars,it is necessary to strengthen the supervision of driverless cars.Fourth,the establishment of the legal regulati on system for driverless cars is not a one-step process.Long-term system engineering.
