In recent years,with the rapid development of China's market economy,network information technology has been continuously updated,and the Internet has become more and more popular in people's lives.People's consumption patterns have also undergone great changes.Compared with traditional face-to-face transaction methods,the online trading method of network technology is becoming more and more popular.At the same time,the economic value of consumers' personal information has gradually become more prominent.In real life,consumers' personal information has been illegally collected,used and sold in an increasing number of cases,which has seriously damaged the personal and property rights of consumers and is not conducive to the healthy and orderly development of the market economy.However,China's theoretical research on consumer personal information protection started late,the relevant legal protection provisions are not comprehensive enough,lack of a perfect legal system to protect consumers' personal information.It is difficult to effectively prevent illegal behaviors that infringe on consumers' personal information.The legitimate rights and interests of consumers can not be properly protected,and the protection of consumers' personal information in China is faced with great challenges.Based on the specific national conditions of consumer personal information protection under the network environment in China,this paper studies the protection of consumer personal information in China's network environment from four aspects.Firstly,the general theory of consumer personal information protection is analyzed in detail.On the basis of existing research at home and abroad,the author deeply discusses the meaning of consumers' personal information in the network environment,summarizes the characteristics of consumers' personal information in the network environment,and classifies consumers' personal information according to different standards.Then it lists the main manifestations of violations against consumer's personal information under the network environment,and analyze the necessity of protecting consumers' personal information under the network environment,and conduct in-depth research on the theoretical basis of consumer personal information protection.Secondly,it expounds the current situation of consumer information protection in China under the network environment.In-depth study of the legal provisions of consumer information protection in China,analyzes the specific situation of industry self-discipline protection and judicial protection,and points out the problems of consumer personal information protection in China's network environment,such as China has not developed a special personal information protection Law,and it is unable to seek effective relief channels after the consumer's personal information has been infringed,lack of specialized consumer information protection regulatory agencies,the industry self-regulatory mechanism is not sound enough,and consumers' awareness of protecting personal information is relatively weak.Thirdly,the laws and regulations on the protection of consumers' personal information under the overseas network environment are comprehensively sorted out.This paper systematically analyzes the decentralized legislative model and the self-discipline of the industry in the United States,and carefully studies the specific legal provisions of the EU and Japan on the protection of consumers' personal information.By drawing on the good experience of other country related regulation,sums up our consumers' personal information protection legislation mode and concrete ways of regulation.Finally,puts forward to perfect our consumer advice of personal information protection under the network environment,mainly from improving consumer personal information protection legislation,exploring the establishment of special consumer personal information protection regulatory agencies,improving afterwards relief mechanism,strengthening industry self-discipline,and improving the consumer self-protection ability to improve the legal protection of consumers' personal information in China,and hope to curb the illegal behavior of infringing on consumers' personal information,thus promoting the healthy and stable development of China's socialist market economy.
