Research On The Legal System Of Network Consumer Personal Information Protection

In the age of big data,it is becoming easier for e-commerce enterprises to collect,process and disseminate personal information of consumers.The collection and exchange of personal information of consumers through the network has become an explosive development trend,at the same time,the problem of improper collection,malicious usage and dissemination of personal information have become increasingly serious,which has seriously violated the personal information freedom,basic rights and legitimate rights and interests of online consumers.In terms of legal protection,China has no specific laws on the protection of online consumers' personal information,and lacks a legal system to protect personal information privacy.Therefore,the research on the network consumer personal information protection system is of great significance to the construction of a reasonable and efficient legal protection system for consumer personal information,so as to balance the power imbalance and interest conflict between network consumers,e-commerce enterprises and society in personal information control and information flow participation.This paper starts from the problems exposed by the personal information of network consumers in real life.Under the current legal system,it analyzes and studies various phenomena of consumers' personal information from collection to circulation.In addition,the author analyzes and studies the legal nature of the personal information of Internet consumers at all stages and the personal information infringement problems exposed by the combination of China's current legal system,draws conclusions and puts forward Suggestions.This paper is divided into five parts:Firstly,the paper explains the current research status of online consumer personal information protection at home and abroad,which provides the relevant theoretical basis for this paper.According to the research needs of the subject,this part also makes a certain introduction to the research methods of this article.The second part clarifies the concept of personal information of network consumers and the definition of personal information of network consumers,as well as introduces the background of the prominent infringement of personal information of network consumers.The third part focuses on the analysis of foreign countries about the protection of personal information in the latest legal system.This section starts with the laws and regulations recently published and implemented in the common law countries and the civil law countries,making a summary of their current legislation and main characteristics.The paper then analyses and summarizes the characteristics and advantages of the two different legal systems in the protection of online consumers' personal information.Finally,the enlightenment from the foreign personal information protection system are summarized.The fourth part analyzes the existing legal system of our country and summarizes the problems of personal information protection system of network consumers in our country.In the fifth section,combining the actual problem existing in the personal information protection system of network consumer in China with the respective advantages of foreign personal information protection systems,some suggestion are proposed to perfect our country personal information protection legal system.
