Research On The Legal Protection Of Government Database And Personal Information

With the continuous progress of various scientific and technological levels,the development of database technology has also advanced to a new level.Promoted by the wave of science and technology,not only did business giants discover the business opportunities and wealth that database technology can bring,but also government departments found the changes that database technology can bring to social governance and national prosperity and strength.Therefore,all kinds of government databases are sprouting up and growing gradually.Because of its unique identity and power,the government can collect information that is not available to ordinary data processing agencies,and can also process these information in different forms.On the basis of absolute power,no one can guarantee the absolute security of the information collected by the government.Under this background,the problem of "how to protect the personal information security and other legitimate rights and interests of each information subject from infringement while ensuring the continuous innovation and progress of database technology and the steady development of government database industry" has arisen.In view of this problem,this paper is divided into five parts,starting from different angles,and try to put forward feasible improvement measures.In order to improve the standardization of the collection and use of personal information in government databases,and enhance the safety factor of personal information in the process of being used by government databases.Improve the management mechanism of our government database.And further establish and improve the personal information protection system,enhance the information subject's awareness of personal information security risks.Let the consciousness of protecting personal information security be deeply rooted in the lifeblood of the development of government database.Promote the coexistence and progress of government database and personal information protection.The first part of this paper briefly describes the meaning of database and government database,and gives some examples to introduce the typical governmentdatabase in operation in our country at present,so as to provide a preliminary conceptual support for the following discussion.The second part of this paper summarizes the general theory of personal information and its legal protection from two aspects: the definition of personal information and the widely accepted basic principles of personal information protection.It provides theoretical support for the following specific measures to establish the personal information security protection system in the context of our government database.On the basis of the first two parts,the third part of this paper briefly describes the challenges to personal information security brought by the operation of government databases,taking the three stages of collecting,processing and using personal information as the dividing criteria.The fourth part of this paper describes the experience of the United States,the European Union and Japan in the field of personal information security protection in the context of government databases,and provides some reasonable suggestions for improving the legal protection of personal information security in the context of government databases.The fifth part of this paper starts with the overall situation of the legal protection of personal information security in the context of government database,and outlines the current situation of the legislative protection of personal information in the fields of laws,administrative regulations and other fields.This reflects the shortcomings of the construction of personal information security protection system in the context of government database.On the basis of the above discussion,this paper puts forward some suggestions on how to improve the problem of "how to protect personal information security from illegal infringement while gradually establishing and perfecting the government database,so as to help to change the current situation of imperfect protection system of personal information security in our country,and to develop our government database steadily.The continuous progress of the industry has been supported.
