Research Study On The Social Assistance Problem Of Persons Released From L City

In recent years,with the construction of China's socialist rule of law system and the construction of country under socialist rule of law,the comprehensive social administration in China has been continuously enhanced,and the social security has shown a harmonious and stable development.However,with the development of the market economy,the emergence of anomie in the process of development of our society is inevitable,such as the crime rate remains high.Nowadays,the recidivism rate of detainees in prisons in China has reached more than 17%.In serious violent crimes,the recidivism rate of prisoners has reached 70%.This is resulted from the experiences in prison and longtime isolation from normal society.When the prisoners return to the society after the release from punishment,they have to confront exclusion from the community,employment,society and etc.Many released prisoners are unable to continue their studies,and it is difficult to find job.Even their basic life is difficult to be maintained,so it is very easy to be re-involved into crimes.This problem is not only an issue to the released prisoners,but also a social issue which shall raise government and public's concerns and is responsibility of the whole society.As a special group in the society,the proper settlement of released prisoners is very important.The social assistance to the released prisoners is not only related to whether the released prisoners can return to the society smoothly and truly integrate into society,but is also related to the harmony and stability of the society and the long-term stability of the country.The social assistance to the released prisoners is not only an important part of the comprehensive administration of public security,but is also an important function carried out by the current judicial and administrative authorities to innovate social administration.In 2014,the Fourth Plenary Session of the 18th CPC Central Committee proposed to "stablish and improve participation of social organizations in social affairs,safeguard of public interests,assistance to poor people,help and education to special groups,the mechanism and systematic channels for preventing crimes.It is necessary to support industry associations and social organizations to play roles by self-discipline and professional service.The social organizations shall play the role to their members with regard to behavior guidance,rules,and rights protection."In 2015,13 departments including the Ministry of Justice jointly issued the"Opinions on enhancing the Salvation and Administration to Released Prisoners" to instruct the works of settlement and help to released prisoners.In 2016,the Ministry of Justice,the Central Comprehensive Administration Office,the Ministry of Civil Affairs,and the Ministry of Finance jointly issued the "Opinions on the Participation of Social Organizations in Help and Education to the Released Prisoners".The Opinion is supposed to actively promote the participation of social organizations in the work of help and education to releasing prisoners.However,the social assistance to the released prisoners is still not guaranteed by thorough legal provisions and not bound by unified and mandatory measures in practice.The social support system for the social assistance to released prisoners is still defective.In practice,we still face many new situations and problems,and we need to continue to research and explore.This article is presented based on interviews to 10 released prisoners.It is supposed to understand their lives back to society,the difficulties and problems they have,current needs and social support they get.This article is analyzing the status quo and predicament of the social assistance to released prisoners by analyzing the data collected from the interviews and is also proposing opinions and suggestion as to improving the social assistance works to the released prisoners in China by comparing the social assistance regimes in China and in other countries in order to support released prisoners back to the society and carry out stable development of the society.
