Research On The Legal Problems Of China's Venture Capital Supervision

Since the Central Committee of the Communist Party of China issued the "Decision on the Reform of Science and Technology System" in 1985,and proposed that high-tech work be supported by venture capital investment,venture capital has been developed in China for more than 30 years.In these three decades,venture capital has made it obvious to the nation's scientific and technological innovation and its role in the development of the national economy.Today,the scale of China's venture capital market is second only to the United States,but there are many deficiencies in the issue of risk investment supervision.For example,the government has not set up an independent venture capital regulatory agency,the current level of relevant legislative effects is too low,and it has failed to form a regulatory model that meets the reality of China's venture capital market.In view of this,the paper comprehensively uses the economic analysis method,comparative analysis method,induction analysis method and other methods to regulate the venture capital laws from three parts:the basic theory of risk investment supervision,the current status of China's risk investment supervision,and the experience of foreign risk investment supervision.Questions are studied.Further,at the end of the paper,it proposed to establish a three-in-one supervision model for government,industry associations,and enterprises by unifying and revising relevant legislation on venture capital,clarifying and limiting the contents of risk investment supervision,strengthening risk investment support,and improving the intellectual property protection system.Improving the legal supervision system for venture capital in China.
