All districts of the city in 2015,is local legislative power granted to the legislation law of the People's Republic of China(hereinafter referred to as the "legislative law")was given after modification,and write the constitution in 2018,due to the lowest level in the whole legislation system in China,the legislation must also is the most close to the social public,directly concerning the vital interests of the public.At the same time,with the continuous development of social life,the public in China are gradually more familiar with laws,and their awareness of rights is also enhanced.The public are eager to participate in the formulation of national public policies,including participating in the legislative body in formulating laws and regulations.The legislation of city divided into districts is most close to the daily life of the public and the public hope to participate in the legislation.In addition,the central government has stated that it will maximize the participation of the general public in legislative activities.In general,this paper consists of the following four parts:The first part,elaborates the background and significance of public participation in local legislation in cities divided into districts,and analyzes the situation of public participation in local legislation studied by foreign and domestic experts.In addition,this part also briefly introduces the research methods used in the writing process of this paper and the existing innovations.The second part,first of all,a more detailed expression of the city divided into districts,public participation in legislation and related concepts,then systematically elaborated the public participation in legislation may from the people's sovereignty,to participate in three of the democracy and deliberative democracy theory to find the reasonable basis,then the public participation in legislation can strengthen the democracy of legislation,ensuring the districts in the city's legislative science and promote the realization of legislative goals in three aspects:shows its feasibility.The third part,analyzes the problems faced in the development,mainly from four aspects:First,the legislative information disclosure system is not perfect,including the content of the disclosure is not comprehensive and the way of disclosure is not perfect;Secondly,the scope of public participation in legislation is too narrow,including limited scope of participants and incomplete participation.Third,the channel of public participation in legislation is not smooth,mainly on the existing channels of participation is not perfect and the new channel is not perfect;Fourth,the enthusiasm of public participation is not high,mainly including low awareness of participation in legislation and the lack of interaction between the legislature and the public.The fourth part,through amendments to the constitution in 2018 and revised in 2015,the legislative spirit of the legislative law,in view of the public participation in legislation in the existing problems,proposed the present stage of public participation in legislation perfect suggestion: First,by expanding the scope of information disclosure legislation and establish a public way to perfect the legislation in information disclosure system;Second,expand the scope of subjects and procedures of public participation in legislation;Third,through the improvement of existing participation channels and improve new channels to smooth the public participation in legislation channels;Fourthly,we should improve the enthusiasm of public participation in legislation by enhancing public awareness of legislation,establishing incentive mechanism for public participation and strengthening the interaction between the legislature and the public.
