Study On Public Participation System Of Local People's Congress Legislation Of The City With Districts

With the deeper implementation of the reform and opening up policy,China's society and economy has made continuous progress,and the legal system is gradually improved.As a crucial part of the national legislative system,local legislation has made great progresses along with the continuous improvement of China's legal system.After the amendments of the Legislation Law in 2015,the city with districts(hereinafter referred to as the city)has been entitled with local legislative authority,laying a legal basis for autonomous management of the city.With China entering a phase of diversified development,social interests have been differentiated.The emergence of stratified social interests makes the disadvantages of original legislative system,such as "legislation by the representative organs " and " legislation by administrative institute",more and more clear.Meanwhile,as our citizens' quality has improved and their legal awareness has strengthened,the public's voice of demanding active participation in legislative activities to express their interests are getting stronger and stronger.In such a context as legislation develops,the central government presents a slogan of complying with the new trend of legislative development,so as to broaden the channels for public to participate in legislation in an orderly manner in all aspects.As a new and important part of China's legislative system,this slogan also presents a new requirement for the development of democratic legislation in local people's congress legislation.By doing so,the legislative work has been directed from official and closed form to democratic and open form.However,It is a new problem to be solved by local people's congress of the city at this stage that how can we steadily push forward such development.With the requirements of comprehensively promoting the rule of law,establishing and improving public participation system in legislation is a new problem to be solved by the local people's congress of the city.In addition to the introduction part and conclusion part,this paper resorts to theory,comparison,history,norm and systematic analysis to study the public participation system of local people's congress legislation in five parts.In the first part,author analyzes and explains the concept of the city with districts,local legislation and public participation using theory and comparative analysis.In this part,author also analyzes the value and significance of the public participation of local people's congresses legislation through systematic analysis,and demonstrates its feasibility.The second part mainly includes the study on the theoretical basis of the local people's congress legislation of the city by using the method of normative analysis and historical analysis.And it shows that establishing the system of public participation is necessary in the development of Municipal People's Congress legislation.In the third part,the author introduces the current situation of the public participation of the local people's congresses legislation in our country through the method of systematic analysis,and also analyzes the problems that may emerge in development,as well as the causes of these problems.In the fourth part,through the method of historical analysis and comparative analysis,the author studies the developed public participation system of foreign countries,and draws lessons from mature foreign systems,which will be enlightening for our country to establish the public participation system of local people's congress legislation.In the fifth part,referring to the newly revised "Legislation Law" and the experience of public participation in legislative work in foreign countries,the author presents suggestions of how to improve the establishment of public participation in legislation of local people's congresses at the present stage in view of the problems existing in this field.Based on the study of public participation system of the local people's congress legislation,the author argues that with the increasing demand of self-management on local political,economic,and social development,as well as the public participation in legislation becoming a new legislative trend to achieve good governance,the public can influence the process and result of local people's congress legislation of the city by active participation.With the public participation in legislation becoming a new legislative trend to achieve good governance,the public is turning their role from passive recipients of legislative activities to active participants.Based on the analysis of the current situation of public participation in local people's congress legislation and consideration of the outstanding problems of public participation in local people's congresses legislation at the present stage,the author referred to the newly revised "Legislation Law" in 2015 and the experience of public participation in legislative work in foreign countries and proposed his ideas on how to improve the establishment of Public Participation System of local people's congress legislation in terms of collecting legislative projects,making legislative information open,consulting on legislative process,making legislative hearings open,demonstrating by legislative experts,assessing legislation and cleaning up bad laws etc..
