Study On The System Of Local Government Power List

It is an inevitable requirement to build a socialist rule of law system with Chinese characteristics and strengthen the credibility and executive power of the government to strengthen the efforts to streamline administration and delegate power.The power list system plays an important role in the reform of the administrative system and the modernization of the national governance system.The power list system not only can effectively regulate the government power,but also can protect the legitimate rights and interests of citizens and guarantee the construction of a country ruled by law.The earliest examples of the power list system in the practice are the mayor's "power list" published in 2005,but until 2013,the Third Plenary Session of the 18 th CPC Central Committee of the Communist Party of China(CPC)pointed out the system of implementing the power list.The guidance of the Central Committee of the Communist Party of China(CPC)and the General Office of the State Council in March 2015 on the implementation of the power list system of local governments at all levels(hereinafter referred to as " guidance ")further regulates the rights and duties of local governments at all levels,The deadline for the issuance of the power list for all levels of government is clearly defined.From then on,the system of power list has become an important means of the new round of the right of government and power.Although the list of powers has not been mentioned for a long time in the form of a specific system,it has achieved very gratifying results with the unremitting insistence of the central and local governments.At the same time,we also clearly recognize that there are still some problems in the implementation of the current local government power list system that affect the effectiveness of the system throughout the country.Therefore,according to the reality,we should further improve the local government power list system.This paper is divided into the following five parts.The first part is the introduction,introduces the meaning of the subject,and through the analysis of the present situation of the domestic and foreign research to get a deeper understanding of the power inventory system,and introduces the research method and the innovation point of the article.The second section is the introduction of the theoretical basis of the system.It is divided into three aspects.Firstly,it introduces the power list,the concept of the local government power list system and the characteristics of the system.Secondly,this paper analyzes the theoretical basis of the establishment of the system,that is,power supervision,limited government and information disclosure.Finally,the necessity of establishing the system is explained,that is,it is beneficial to implement the legal principle of government functions and powers,realize the goal of limited government and efficient government,and at the same time help to realize the openness and transparency of power and protect the legitimate rights and interests of citizens.The third part is to analyze the practical situation.The first is to classify the development of the system,including exploration,establishment and all-round development of three stages.The second is to analyze the practical results of the system,such as the wide range of implementation of the system,and enumerate the more typical practice in the construction of the list of provinces and municipal governments,and further clarify the power and responsibility of local governments and their functional departments;There has been a considerable reduction in matters of power.The fourth part is the analysis of the problems existing in the practice of our country,and the causes of the problems.The existing problems include the unclear legal status of the list of powers,the inadequacy of the binding force of the list of powers on the administrative subject,and the formulation of the list of powers.The main body is too single,the procedure is not strict enough and the standard is different.For the emergence of these problems,the author analyzes the reasons from three angles,namely,the power list does not have accurate legal positioning,the establishment of the power list system lacks strict regulations,and the system lacks strict supervision and punishment mechanism.The fifth part is about the problems existing in the system,and some suggestions are put forward.First,the legal status of the power list is determined,so that it has the legal effect in the administrative law enforcement,and at the same time,when the right list and the law conflict,the law is based on the law;the second is to strictly regulate the development of the local government power list,in particular from the main body,The third is to improve thesupervision and punishment mechanism,organize the training of the personnel of the power list,establish the pluralistic supervision mechanism and establish the relevant accountability system.
